LIke title said i have bought a phone from **bleep** China , returned the phone after i have find out that is broken . I have call PayPall two times just to make shore that everything is ok , and they have ashured me that everything is allright . After 2-3 monts they have closed my case and told me that i have send a wrong INFO about something . So now im missing 299 $ and i got no one to complane . And best thing is while every thing happend i was i Europe and unable to call paypal to check what the f... happend .
Dude from China did respond on my mail ones and told me to hold on for 2-3 weeks and that was 7-8 monts ago .

I think you're pooched.
You can try filing a chargeback on your credit card if you used it to pay for the phone, but 8 months is a long time. Call the customer service number on the back of the card and see what they say.

I had a similar incident. I bought a set of window switches for my Fiero, advertised to be in perfect condition. When they arrived, they were cracked and sun-damaged. I emailed the seller, and told him I wanted a refund. He agreed, so I sent the switches back. I received the Return Receipt dated 04/19/10. I sent three email requests fro payment, which were ignored. When I tried to open an eBay dispute, I was told that more than 45 days had elapsed, and there was nothing they could do. Likewise for negative feedback. I had thought I had two months (60 days) to respond. It's not until a problem needs to be addressed that the 45 days is mentioned.
PayPal will not even look at this event, either.

The 45 day limit is set out quite clearly in the user agreements for both sites.
If you used a credit card to pay for the item, file a chargeback by calling the customer service number on the back of the card.
