The onus is on your to provide written proof the item is fake DURING the claim process.
That proof can be got from trading standards / or a seller or company that makes the genuine item.
If all a buyer had to do was say an items fake to get a refund without any proof then every buyer wanting a refund would do that wouldn't they.
Also whilst its against the law to sell fakes in many countries it is NOT against the law to sell fakes in China or various parts of Asia.
So if that seller wants the item back then you have to send it back fake or not.

Yes if the seller is in the US as well.
Its not illegal to sell them in China, so if you think its illegal in the US for them to send the fake to you then what legal action do you think a US lawyer can take against a Chinese seller. Does your little item warrant an international legal suit? If so then i hope you are a millionaire.

I do not care about US law as it DOES NOT APPLY to a seller or merchant in CHINA.
If you are right then go get the Chinese merchant arrested and charged then. ...... 🤣

Think you missed the point, the original poster was complaining about a paypal dispute where they were told to return a fake item back to the seller for a paypal claim refund.
They didn't want to return said item because it was FAKE but I said that unless you prove to paypal that it is fake then you have to return it for a refund.
Also in some countries fakes are allowed to be sold.
I am always advising folks to chargeback via their banks or card issuers if they lose a paypal dispute BUT that was not the question. The question was about paypals requirement to return the goods back to the seller before being refunded for a paypal claim.
Personally I always fund my paypal payments via a credit card for this very reason so IF a paypal claim fails I have back up but that is not what this thread was about.
