Screen repair goes wrong, I send the phone back, paypal pay out, I have no phone

I send a Samsung S7 edge for a 3day turnaround screen repair 28 Aug

It's returned to me late but with a fault 11 Sept

I send it straight back signed for special delivery the same day

I ask seller when I'll get my phone.

The seller never returns the phone.

Open a dispute with paypal "item not returned".

They see the original return tracking number and say that it has been returned, case closed in the sellers favour!

I have no phone, no repair it appears that my phone has been stolen and Paypal are happy to take my money.

If a seller has a tracking number that proves delivery of the item to you then you would always lose a dispute for non receipt.

What you should have done was open a dispute BEFORE sending it back citing 'item received but not as described', then paypal would have seen you sent it back trackable and you would have received a refund.

 

All i can suggest now is..

 

1. If you funded that paypal payment via a credit card then contact your card issuer for a chargeback.

2. Small claims court.
