Paypal dispute: Buyer only offering refund if item is returned in original condition

Hi, I made a purchase for a pair of shoes on eBay and found out months later that they were counterfeit. I have since opened a case with PayPal to get a refund. The seller replied on the very last day and PayPal decided they will issue the refund only if the item is returned to the seller in its original condition. I have no problem returning the item, because its counterfeit and I just want my money back but the shoes have been worn twice, so they're no longer in their original condition. Is there anything I can do about this? It seems really unfair to only be able to get my money back this way, like the seller is scamming and trapping me yet again after falsely advertising on eBay. Has anyone experienced a situation like this?
