Fraud items

I wonder if anybody else has encountered this bizarre decision from Paypal when they reported a fraud.

In April I bought some airpods for my son - I accidentally used my debit card on ebay instead of payal, but I paid paypal through a guest account as was shown on my bank statement.

The airpods stopped working and I took them to apple to prepare and they said they were fake and gave us a letter to that effect. The seller did not respond to any of my emails so I contacted the chat line on paypal.

I explained my situation, opened a case and provided all relevant documents. The chat person said I should receive a full refund if the seller didn't respond.

Within an hour my case was refused and closed because the seller said they had been altered. There is no evidence to suggest or prove this, it is completely untrue as my entire family could testify and yet Paypal have decided to believe the seller (who sold fake items!). I was given no further chance to deny this which feels completely unfair and wrong that the person should simply get away with selling fake items. I have the original box they came in and the serial number on both the box and airpods to prove they are the ones they sent.

This seems completely bizarre to me and I have no idea where I can go with this. Is there an ombudsman or somewhere higher where this could be reviewed.

If anybody has had a similar experience I would love to hear from them and also if there is a way to resolve it.

If you funded your paypal payment via a card then see if your card issuer will help you.

Or if the seller is UK as well then firstly I would contact him to state that if he does not refund you will report him to trading standards and if that doesn't work you have the option of the small claims court.
