Been scammed but unsure what to do next

6 days ago I made a payment of £250 to a seller who had promised to send a mobile device. However, it turned out that this was a scam and that he never intended on selling a phone. I phoned up Pay Pal today and made a complaint and it has been out straight through to the escalation process. The agent on the phone said tht the seller has 10 days to respond before further action is taken to retrieve my money. I am just wondering, were the sellers funds frozen or could he have transferred his money to a bank account? Ergo, I wouldn't be able to be refunded? Bearing in mind I complained after just 6 days of the transaction. Also, can Paypal contact his bank account and transfer money automatically to PayPal account, in order for me to be refunded? Thanks

Does not matter if he has funds in his paypal account or not.
If the seller can't provide a tracking number to prove DELIVERY of the item to you then you get a refund.
If paypal can't access funds from the sellers paypal account then they refund you themselves, that is what the buyer protection programme is all about.
They then limit the sellers paypal account until he pays them back.
If you want to stat a dispute in the future all you have to do is click on the resolution tab in your paypal account > file a claim for non receipt of item....that will save you ringing them up.
