Ripped off by Ebay and Paypal

After years and hundreds of purchases on Ebay/Paypal I've been scammed and no one will help. I bought a flashlight from a vendor in China and after a long wait it arrived damaged and not working. I contacted the vendor who said he was sending another but pleaded with me to wait for the replacement before contacting Ebay or leaving negative feedback. He kept putting me off and then Ebays time line expired and they would do nothing except send me to paypal ( could not even leave negative feedback ).....at Ebay and Paypal I talked to robots and then foreign women and for a hearing impaired person it was a nightmare. Now Paypal wants me to return a $25 flashlight to a remote province in China to be reimbersed although the sellers Ebay listing clearly states if an item is defective he pays return shipping costs ( it would cost me more to return it than its worth )
I have ALL the EBAY messages sent to be by the seller instructing me not to return the defective one and that he would ship me a new one or refund my money !!!
Can't someone just read these and get my money refunded ?
DO NOT BUT ANYTHING FROM tonsee_shop AND I WOULD AVOID CHINA.
I can't believe Ebay/Paypal has no on-line, email contacts....just bots and foreign operators.
Paypals final answer......give them the tracking number of the item being shipped to China or Cancel the claim, I have until Nov 29.
In all the years I have bought on-line I have never lost a cent on a purchase until now....I never thought it would be Ebay/Paypal.
ALL IT WOULD TAKE IS FOR SOMEONE TO VIEW THE SELLERS LISTING AND VIEW HIS MESSAGES TO ME.

paypal policy on item not as described is to return the item with tracking,you pay return shipping.
EBAY will make the seller picks up return shipping,for domestic purchase,it can send you a return lable paid for by the seller,with overseas seller,it cannot send shipping label (it cannot go to another country postal website and print labels like Rwanda,Turkey,China,Ukraine etc) so it can only state seller pickup return shippng but cannot enforce it.
BEFORE you buy from any overseas seller,you must be aware return shipping will be on your dime,do your homework before you leap !
if you use a credit card,file chargeback,you get to keep the item and get your money back

I did check.....sellers listing said they would pay for return shipping.
I used Discover.....if I dispute the charge wouldn't it create issues with my Paypal account ?

NO,Paypal will just let the seller knows a chargeback has been filed and pass on the documents SELLER submitted to your cc issuer to review.
Make sure you emphasize item is defective and seller promised a replacement but never keep his promise.
if seller loses,he will pay $20 fileback charge,he is better off just let Paypal refund in full.
Does Paypal care in the long run?
Yes,it does,too many disputes,too many charge backs,it could restricted your account.

you have 180 days to file chargeback with your cc issuer

you are ripped off by the seller,not Ebay or Paypal,NO ONE FORCES YOU T O BUY FROM THIS SELLER OR THAT SELLER .

There are supposed to be protections.......the seller can't scam me unless Ebay/Paypal allows it......they can truly review the case and messages and refund my money ( a replacement light that works if fine too )

Buyers are free to buy from whoever,whereever,no one can watch over what you buy and where you buy.
Paypal has ruled in your favor and ask you to return the item and refund you in full,what else did you strike with the seller is outside Paypal.
PAYPAL cannot take more from the seller than what you paid him.
DID seller promise a replacement,did he offer to pay for return shipping,did he offer a piece of candy or a bottle of champagne?did he ask you to be patient and wait till it is past Ebay deadline for buyer protection?
You agree to wait for an replacement,now that repalcement is not coming,you seek justice ,justice has been granted-return the item and get your original payment,but thats not good enough for you.
You said you have been buying on Ebay for years and hundred of items,did it ever occur to you ,buying from overseas seller has more risks than buying domestic?
As for ignoring your emails showing seller promised replacement,return shippings,Paypal is not judge Judy,it cannot enforce anymore than what you dish out,which is item plus original shipping,besides someone could fabricate emails and videos .
Ebay customer service does read emails ,only if they are sent within Ebay ,this is how they know these emails are for real.
Did you read this Chinese seller feedback,I bet he already has some negative feedbacks on slow shipping,faulty product etc.

The seller has to absorb return shipping as per his Ebay listing.....it should never have been a Paypal issue.
I can't even leave negative feedback.
The only fault I have in this case is trying to work with the seller as he requested.

Ebay has always been a fleamarket,folks flock to EBAY because it is cheap and if y ou are good at treasure hunting,there is diamond in the rough.
But like I said it is a fleamarket,not Nieman Marcus or Cartier or even Walmart.
If you cant take the risk,then go to Walmart or Target or even 99 cents only store,they have a return policy ,you dont have to pay postage but you do have to drive to the store to make the return.
buy from domestic seller,if item is not as described,Ebay will make seller pays for return shipping.
