Filed a dispute for item not Recieved but seller added tracking after case isculated

I bought some shoes through a site that claims they work directly with PayPal. Made a purchase on DEC 08, 2016. Before purchasing, I read through his bio and shipping policies. It stated that they ship within 24 hours or payment Recieved. Dec 15, 2016 I still haven't Received a shipping/tracking info, contacted the seller and no response. Contacted him on Dec 16 and no response so I called PayPal and tried to disputed so I can get my refund so I can get another gift in time for Christmas. Seller responses on Dec 21 with "tracking info" . I checked the tracking and it said that he shipped on Dec 20. Will I win this case? I don't need the item anymore, I just bought the same item from somewhere else to ensure Christmas delivery. I just need a full refund

If the item gets to you before the time of the claim has expired and tracking shows the item as delivered to you then you may not win.

Yeah, it sucks. Because the dispute is scheduled to end on the Dec 27th. And he shipped the item using an "overnight" service which will make the item delivered on Dec 22nd. PayPal can't override this? The case has escalated before he even shipped the item.

once it is delivered then you lose the case.

but then you can still tell him you want to return the item?

But the seller can refuse.

But if the item is misdescribed you can CHANGE the dispute to one of received but not as described.

 

OR you can just re-sell the item yourself. Its how I got into selling myself, I got an item that I no longer wanted. But there was nothing wrong with it so I just re-sold it on ebay myself...........and made a profit ...........LOL
