Is it possible to open a claim if the seller misrepresent his terms of shipping?

Hello,

 

I've recently sold item that the customer indicated arrived damaged internally and externally.  He sent me pictures of my item which appear to be put through the ringer, mud and cracked corners.  We tried to resolved via email but ended up going to Pay Pal dispute as the buyer kept insisting that the item was not as advertised.  I've provided pictures of the unit condition prior to shipping and shipping receipts which was under the buyer's FEDEX account.  For 3 weeks, I haven't heard anything back on decision from Paypal until today and they favored the buyer. 

 

The pictures that the buyer emailed me was not the condition that the unit was shipped.  It was well packaged and dropped off at nearby FEDEX station. My question is this, how can Pay Pal favor the buyer without investigating how the package was handle by FEDEX.  If it was FEDEX fault for the damages and it was shipped using buyer FEDEX account, who should follow up with claim with FEDEX, me or the buyer?  The value of the item request refund 2300$.

 

Any help with my situation well appreciated.

@Happychow i think PayPal messed up big time here,it should be bought up with fedex not PayPal because they mishandle your package,$2300 is that really worth of a damage?or maybe the buyer con you on this one. So I guess I have a chance if I open claim.

Hello BG75,

 

Thanks for chiming in on my problem.  Well, I am awaiting for the item to be return to me from the buyer.  I am preparing for the worse as the pictures shows it all.  After disappointing decision from Pay Pal, I've called them this afternoon to ask about how this claim was handled and what lead to decision of siding with the buyer.  They told me to wait until receive the item back and if not in the same condition that I've sent it, call Pay Pal to file claim with FEDEX. 

 

It's possible that the buyer did bate and switch but can't rule out that FEDEX mishandled the package.  I did ask the buyer to provide pictures of the box and they told me warehouse disgarded the box. 

 

What action can I take once item is received and not in same state as shipped?  Do I have to follow up with FEDEX myself or is it PayPal that will champion this effort for me?

PayPal,disputing on shipping company is like banging your head on a brick wall,trust me,been there done that,I've learned my lesson whenever I shipped an item double box or styrofoam will be used to protect the packaging.
