Sealed item arrives unsealed, Pitney Bowes or seller responsible?

I just received a supposingly brand new and sealed item that was unsealed with clear signs that the item inside the box was repackaged with the original packaging material. All the seals including one big white one sealed by the manufacturer was cut open.
I could have paid quite a bit less if I was willing to buy a open boxed version of the item but went with the sealed route.
How do I know if Pitney Bowes is responsible for the opened package or if the seller actually sent me a unsealed package?
How would I go about requesting a refund in this case? eBay says that it will be Paypal and not eBay who is responsible for any sort of coverage on the item regarding any problem.
