Hello community, so yesterday I have tried to make an purchase of a service through an online company. After talking to the sales agent of that online company, I have agreed make an purchase on a product namely "30.26 tutoring hours". The transaction was paid using Paypal and I have got my receipt back. The twist is: after leaving that website, I read some review websites I have realised that the website is actually a scam website, so I have decided to lodge a refund from that company. Not surprised by the reply I have got from the company, the company replied me with something like "the expert is now handling your order carefully, dear..." and keep reassuring I wouldn't need to worry about the service not being fully delivered. Their over-friendliness from the staff and the way they beat around the bush further confirms my just further confirms my belief: this is a scam! Thus I decided to reach help from Paypal using the phone service. The person who I talked was helpful and the person has also helped me to discover an important piece of information: the item description on the receipt issued by the online company reads "20.4x tutoring hours", instead of the previously agreed "30.26 hours". Knowing this information, I tried contact the service provider by saying your sales agent may have made a mistake or something, such that the product description written on the receipt is not the same as what we have previously agreed on. They never acknowledge or admit that they have made such a mistake, and also tried to distract me by saying "a specialist has already been assigned to provide me a service", and doesn't willing to do a full-refund (said to be willing to do a 75% but I am not happy with it). Since I am now trying to get full-refund, I reiterate the issue is not about I am not happy their service they are going to provide me (even though I know they will not deliver quality service after googling lots of reviews saying that company would only give very low quality work). I reminded the company is at risk of fraudulence cause what I have agreed on is not the same as what written on the receipt. Whenever I tried to tell them to "I am going to escalate the issue", that company just replied to me that they would like to "close the matter amicably".
The said they have already assigned an "expert" to work on my problem, as an excuse to support those 25% money would go to that person. My company would also be at lost. I then asked for the contacts for the "expert" or the person in correspondence, they provided a name that could not be found in the website's "List of our experts". What an obvious scam!! Question: when there is an mismatch on what the description on the merchandise on the receipt, is that a fraudulence? Is that a breach of The Trade and Descriptions Act 1968? How can I make increase my bargaining power in this dispute? In this sense, would I be able to get full-refund? Final note: next time I would make sure I read lots of comment before making an online purchases.
