Re: PayPal requiring me to ship counterfeit goods ...

Thank You! literally tried to address this problem over a year ago- as you saw- and it is amazing that the problem has gotten worse. As a buyer and seller on eBay for over 10 years, it is evident that there is zero control over Chinese Counterfeiting. This hurts us all. PayPal literally told me to violate Federal Law (thanks for citing them!). To ship back to China with the required insurance and tracking requires the postal service to have a registered address- none of these warehouses even existed in their system. It also costs a fortune! The postal service clearly knew what I was sending back was counterfeit. I tried to get PayPal to understand this- and literally was told to try a different post office! If it got held up in Customs and arguably prosecuted by the Inspector General, then I would get my money back. Gee- thanks. I am forced to commit federal crimes and return a counterfeit item to get back my money spent on a Spiderman toy for my son with autism. Try leaving negative feedback? Good Luck! They get it pulled or have scammed so many their percentages do not get reduced. There are clearly Certificates of Destruction and other routes acceptable. But, we are not the holders of the copyright or trademark being infringed. Thank you for continuing the fight for common sense. ... View more

I was sold counterfeit items, filed a dispute through the Resolution Center, escalated to a formal PayPal Claim, and was told I now need to return the counterfeit fake items to a warehouse address in China to obtain a refund of the product price. My point is that the Seller is clearly violating Paypal's Intellectual Rights Policy, and PayPal is directing me as a consumer to return counterfeit goods to China, fill out a false customs declaration, then upload tracking at my own cost.    I was told at postal service that mailing counterfeit items is illegal, they could not confirm China Warehouse address for insurance and required signature confirmation, and then when filling out the Customs Form said I was aiding or abetting in a federal crime by putting counterfeit items in the post. These items should be destroyed or returned to actual intellectual property rights holder for destruction. If returned to China, will just be re-sold.   This policy clearly needs to be reviewed and changed to conform to their Intellectual Rights Policy. I can stomach paying cost of return postage. But being told by PayPal to fill out a False Customs Declaration and put Counterfeit Items in the Mail back to a Counterfeiter with my own return address and name exposing myself to liability, is unbelievable.   So, I called Paypal Customer Service after sending two email, explained the situation, that the local Postal Service just clearly said what I am being asked to do is ILLEGAL, and asked for options. A few other posts have suggested Certificates of Destruction or cited Paypal's Intellectual Rights Policy. I clicked on "Legal" and it literally says: Paypal's Intellectual Rights Policy: What is PayPal's policy regarding intellectual property rights? PayPal prohibits transactions for counterfeit items and unauthorized replicas or copies of items.    The phone representative put me on hold- then told me "Let's try to ship it again" (me taking it at my cost, filling out a false customs declaration with my own return address, and putting a box of counterfeit items to China in the US Post.) She then said- "the uploaded tracking I do will tell PayPal if the item is held up in Customs" and I will then get my purchase price refunded! Cost of international shipping, insurance on counterfeit goods, and tracking confirmation requires by PayPal is on us the consumers.         ... View more
