Not escalating a dispute to a claim.

I have a case currently with paypal in which a buyer threw up a dispute a few days after he received the package claiming it was second hand, or some such. It's hard to say since I think he's running all his responses through google translate or something, and I faintly suspect it's some kind of poorly thought out scam, since I have all the photos, tracking info, etc, I should need. That being said, if neither the buyer or myself escalates the dispute to a claim (he hasn't been responding to the case at all), what happens at that point? Will they release the funds to me that they're holding or.....? ... View more

Regarding the dispute issue: Does paypal automatically go in favor of the seller when the case isn't raised to a 'claim' within the 20 day windows? I'm in a dispute now (initiated by the buyer), but since I'm not %100 certain if the buyer is trying to scam me or not I don't necessarily want to take it to a claim. ... View more

What happens if neither side escalates to a claim?   I have some Korean dude with 0% feedback in LA who is sending me mumbled responses I've made to a "Item not as described" that appear to have been made with the magic of Google translate, but he barely ever responds and although I have a ton of evidence to the contrary of his claims, I'm not sure I want to take a hard-line in the remote case that this is just a language barrier problem (which I doubt-I think he's trying some weird scam).   I realize in the seller threads the seller ALWAYS loses, and vice versa in the buyer threads, but if I can just wait out this dispute I'd rather do that if that would settle things (in my favor, of course). ...
