Hi, this is my first post to the Paypal Community. I feel so ripped off right now that I felt I had to speak out. I have used Ebay and Paypal for over 10 year, mostly without a problem. However, last monthg I advertised a car part on Ebay. I made the advertisment very very clear and accurate. I included several pictures at all angles of the item. I included the part number and the date range of vehicles it suited. I also included the words "Please check part number and pictures before buying, to avaid buying the wrong part for your car. So imagine my suprise when after 8 weeks following the sale of the item, I get a Paypal dispute message with the buyer stating "The item does not match the vehicle specified in the description." I know 100% it matches because I confirmed it with the vehicle manufaturer first, and I also made it very clear in the description that the item matches vecicles with a specific navigation system. Notwithstanding that the front of the item has a special button configuration matching specific cars only. So in other words, if the part needing to be replaced matched the picture of the front panel button configuration, then the item WILL fit 100%. Anyway, it was obviouis that the buyer had not checked before buying. And then decided to try blame me. I responded to the dispute with almost a dozen pictures and documentary evidence supporting my defence to her claim. I wrote a very detailed and lengthy response including all relevant pleadings and particulars of my defence. Today I get message from Paypal telling me that the dispute has been decided in the BUYERS favour (WTF)? I have seen no evidence of her claim. Only one sentence pleading that the item was not as described. No particulars or submissions in support. I immediately rang Paypal for an explaination. The lady of whom I spoke to was clearly of Indian or Pakistan decent, was clearly not listening or comprehending my submissions in reply, and from what I could make out from her explaination, the buyer would get a refund no matter what I said!! What type of system is this? Completely void of any due process or procedural fairness. Completely in breach of Australian Consumer Legislation. And bordering on extortion. Paypal are forcing my account to be debited the amount of the refund, whether I agree or not. This is total **bleep** !! If I tried to run a business this way I would be sued so often I would be bankrupt. How can a purchaser get away with lying to cover her own mistake, and then be rewarded with a full refund for her lies? Meanwhile, the innocent seller gets nailed by Paypal with a possible negative feedback score and has to repay money for a transaction that occured over 2 months ago? My Paypal balance is now in ther negative because I usually only have a couple of dollars in there. I cannot use Paypal for Ebay until I put the refund amount into Paypal to cover the damn false refund. It is now effectively a bill for $130 of which I spent soon after the sale. Loose Loose as a seller...win win as a buyer !! What a load of BS. Shame Shame Paypal. I doubt you even looked at or considered my evidence, or maybe you did but didn't understand how it apples here in Australia !! Please see s18 Australian Consumer Law, or got the ACCC Website for more info. PJ
