Seller is abusive and not returning my 450$.

Due to the sudden demise of my grandfather I was visiting India when my sister residing in USA bought the flight upgrade for me from this Seller on Sept 26th using my Credit card. I was not aware of the charges and I filed the dispute to this Seller but the moment my sister informed the same day I closed the dispute and apologized and requested Seller not to cancel the upgrade and I've closed the dispute. but the first thing Seller did is cancelled the upgrade right away and promised me to refund my money but he said once he won't have the confirmation that case is closed he won't return my money. In meanwhile he has also offered me he can give the same upgrade for another flight but this was worthless to me as I had no future travel plans. On Nov 3rd there was official confirmation on the case being closed and money got debited from my account. When i have tried reaching to the Seller he is making an excuse of Refund button on Paypal not working and not ready to authorize the Paypal to reverse the money or looking for any other means to return my money. It has been 5 months now following up this seller asking for the refund and now he is using the abusive language in all his emails that i have tried steal the upgrade and this is what happen to Indian crooks like me and as i am not the US citizen to take any legal action against him. I will be deported. He has been racist and insulted me and my sister. When I try to create a new dispute on Paypal, on the item, I can't. I had been fooled from my seller, he kept on saying he would refund money and to cancel dispute and i listened to him i did that, and now when case is closed, he claiming i want to return money but cant do so because refund button not working.   Upon contacting Paypal they are appologetic about this but they are saying they cant help and letting him to enjoy my money, i am crying now why i trusted Paypal!!! ...
