I agree that I cannot force payment, but yes have proof and full ebay messages to show he acknowledged receipt post refund, but as the ivoice has not come from ebay he is refusing to pay. Small claims for £39 is a bit extreme and with the way the system works I will be out of pocket, and the way the buyer replies it would suggest he is aware this will not happen. I just wish ebay and paypal would offer a little more protection post a dispute.
