So, I have been dealing with an artist who I had commissioned to draw a piece of art for me. ~ I approached her and asked if she was open for commissions, she said yes and gave me her paypal to send funds, I sent fund and she asked what I wanted ~ I explained in detail what i wanted, provided references, and confirmed with her asking if she understood what I wanted. She said yes she understands ~ a few weeks later I get my art piece, It is not what I wanted.. it looks super sloppy like it was rushed, and dull, It is also not in the pose I had requested. I ask her "I thought we came to an agreement of what I wanted" she said "Ah, I forgot we did, I just liked this pose so I went with it" (heres proof) ~I told her I didn't like it and asked if she would do it over with my specifications (because I don't want to pay for something I didn't want/ask for she said she would do it even though she doesn't normally do redos ~well skip ahead a few weeks, I ask for an update and she gives me all kinds of excuses from, "My scanner is broken and I forgot to carry my cell phone with me so I can't provide photos of the finished pic untill tomorrow" Well.. tomorrow comes and she is sick and doesn't feel like getting out of bed, ~this goes on for a while.. she said she would send me a photo of the 2nd picture she did as she finished it but can't because she "lost" it. and said she will start a 3rd piece for me. ~at this point I ask her for a refund as I don't feel comfortable dealing with her wishy-washiness, but she said she doesn't do refunds once a picture is completed. At which point I explained that I never got a finished picture fo what i wanted then she pointed to the finished picture of what i DIDN'T want that was not to my specific requests. she again pointed out her Terms of Service where it says she doesn't offer refunds after a sketch has been provided and deemed by the buyer she can complete the picture. I also pointed out to her that she never gave me a sketch to approve and she finished it to her own specifications instead of mine. That was when i also mentioned she voided out her own TOS which voided out our contract. and I just wanted my refund back. she kept saying she won't do a refund and I have to deal with it or wait for her to finish my picture... Now that all that is out of the way.. i contacted PayPal after speaking to the artist and did a "product is not what was received" claim. But I got off the phone with them after waiting over 2.5 months for a resolution, only to be told that custom pieces are not covered by fraud.. I feel I am being **bleep** all around by both Paypal And this artist, Paypal offered me $20 as compensation but i wanted the full amount. I have provided paypal. with ALL screenshots of our conversation, showing I did not get anything at all from this artist... Is there something I am missing.. or is this something paypal needs to fix? any info would be greatly appreciated!
