The question still remains, who wins, buyer or seller? If you need a role-play, you can assume I am the supplier (seller). ... View more

@DPCreations wrote: At this point I'm really confused; the OP has changed, explained, and re-explained so much from the initial post, I have no clue what happened. I think you might be confusing yourself. If you need clarity, please specify what is confusing to you and I will explain it for you.   To recap: The transaction is between a supplier and a company, for a gift card delivered electronically, and the transaction is paid for via paypal balance and paypal mass payments. That's all there is to it. Who wins a buyer claim since neither is covered? ... View more

@sharpiemarker wrote: When you say there won't be a chargeback, then you are talking about a dispute between the gift card code seller and their vendor?   Or are you saying the end user?  The one who actually receives the code to use after payment for it?  Because they can certainly use a credit card.   I am talking about a dispute between the gift card code seller and their vendor, yes. Since this transaction is paid for via a paypal balance (a requirement of paypal mass payments), there can be no chargeback. ... View more

The buyer is running a gift card reselling business. Paypal mass payments is intended to be used for paying out employees, suppliers, etc. The buyer is using the service as it is intended, and paying out all of their suppliers.   As stated before, paypal mass payments are made directly from a paypal balance, so no bank is involved and no chargeback can be filed. I don't know if this is a moot point, that's why I'm asking - how does Paypal decide when neither party has protection? I was hoping someone would have experience with this before, or that a Paypal representative could weigh in. These changes were only made to the paypal user agreement a few months ago. ... View more

If the seller had actually shipped a physical gift card, the outcome would be different.   The issue at hand here though is that there is equally no buyer protection. My question is how would paypal decide when there is no protection for either party? I could just quote the paypal user agreement that states no buyer protection for the purchase, no?  ... View more

There is no way to prove who used the gift card. This questions is regarding a case of buyer fraud. It seems that Paypal predominantly sides on the case of the buyer. I am curious though what Paypal would rule when neither buyer nor seller has protections. Are there any criteria that govern such a case?    These new Paypal rules which stripped all seller protections for gift cards have been in place for a few months now. Has nobody come across this yet? ... View more

Who wins dispute over Digital Goods with no buyer ...

I'm specifically interested in a transaction with a gift card. Note, this is not through ebay - paypal only. Let's say I provide a gift card code to somebody over email, and they send me a payment via paypal. Months later after they've used the gift card, this person decides to file a dispute for the card. Who wins is Paypal doesn't offer protection for the buyer or the seller?   The Paypal User Agreeement Section 11.5 says gift cards are not eligible for SELLER protection. The Paypal User Agreeement Section 13.3 says gift cards are not eligible for BUYER protection. How does Paypal mediate a dispute by either party then? Are disputes not allowed at all? ... View more
