I disagree with your comments. By accepting my statement that I would take no responsibility for non-delivery the Buyer agreed to this change in the contract terms between us and - under English Contract Law - she must bear the loss if the goods go missing in the mail. If PayPal's terms and conditions are contrary to this then they are illegal under the Law. I would point out also that Tracked and Signature required postings are also to ensure that the Mail companies deliver safely to the consignee and their employees are denied an opportunity for theft of valuable items - bearing in mind that most theft opportunities relating to mail are within the Mail companies organisation itself. ... Hi Michael, You are obviously learning the hard way that Ebay and PayPal are happy hunting grounds for the criminals of this world and you will get absolutely nowhere looking for help from Ebay or PayPal to resolve the theft of your hard-earned money. Well .......I had a bad feeling about this transaction when she was bombarding me with Emails insisting on no Tracking and no Signature requirement. However .......she accepted my statement that I would take no responsibility whatsoever  if the item went missing in the Mail and indeed she paid a reduced cost for a non-tracked and no signature shipment to the U.S. Therefore, under English Law, the contract trems between us have been changed and any loss is for her to bear.  I do have the Royal Mail Proof of Posting as proof that the item was sent to her. PayPal must be forced into compliance with English Law as their practices leave a lot to be desired and are, indeed, illegal in many respects. ... View more

I do not agree that the risk of non-delivery of an item falls on the Seller in this case. I advised the Buyer that -  as she insisted on no Tracking or Signature requirement that I would NOT accept responsibility if the item went missing in the mail. She continued to insist on this and , indeed, paid for a cheaper non-tracked delivery -  therefore, under English Law the amended contract terms have been accepted by her and she must bear the loss if the item goes missing. I couldn't agree more with your comments  ...........PayPal and eBay are very faulty organisations indeed as I have found out to my cost and the whole system is extremely difficult to follow and understand and is very heavily weighted in favour of crooked buyers. Trying to respond to either company is virtually impossible and their options for getting a Dispute resolved properly are very few indeed - at least for the Seller !   In my case, my overseas Buyer actually insisted on a 'non-tracked' and no signature requirement transaction and omly paid for a normal standard airmail small packets cost. She has now raised  a PayPal Dispute against me and is demanding her money back as she hasn't received the item. I have a Postal Receipt, of course, but this does not seem to matter to eBay or PayPal as I am unable to provide a Tracking Number - despite the fact that the Buyer insisted that she did NOT want Tracking or a Signature !  Stupid or not ??????   Best of luck ........I'm going to my local Citizens Advice Bureau on Monday to see if they can make sense of all this nonsense and stop PayPal from freezing my funds or using them to refund a crooked Buyer ! ... Hi Kernowlass,   Well...........my overseas Buyer actually insisted on a non-tracked transaction, in writing, and also insisted on a no signature transaction to get the cost of shipment down.  Do you still think I should be refunding her payment if she now says she hasn't received delivery of the item ?  I strongly suspect that she is a crook who goes in and out of eBay and PayPal at irregular intervals using different names and addresses and scamming honest Sellers out of a fortune. PayPal seem to be heavily weighted in favour of the Buyer and it looks therefore like overseas crooks can have a field day as they get the goods and then get their payment back if they claim not to have received them ! ... Hi Smokybear,   I am UKARRANVIEW and I have have just posted an very similar complaint to yours but my Buyer actually insisted by Email that she wanted a non-tracked transaction and no signature requirement and would only pay for normal airmail small packets cost. She has now raised a Dispute against me and wants a full refund as she says she hasn't received delivery of the item !   PayPal - in their infinite wisdom have frozen my funds and asked for a response to the Complaint. However, like you, I have found that their 3 response choices for me do NOT apply to my case BUT .......if you cannot tick one of their boxes then you are unable to actually make a response !!! Stupid or what ????  They also have the temerity to say that if I don't respond within 7 days then they will use my funds to refund the Buyer !  If that is not a bloody cheek then I don't know what is !   I'm going to my local Trading Standards office on Monday to see if I can get some assistance there and I'll let you know how I get on. PayPal Resolution Centre problems

I have a dispute with an American Buyer who says she did not receive the item she purchased and is now demanding a refund of her payment from my Paypal account. However, she insisted that I send the item to her WITHOUT Tracking or the requirement for a signature although I pointed out to her that I would not therefore take any responsibility if the item got lost.   She has now raised a Claim against my Pay Pal account and PayPal are asking me to respond. However .........I have to respond to 1 of 3 options only .....none of which apply to this transaction ! In the meantime, they have frozen the funds in my account and I can't get access to my rightful funds or buy anything on Ebay !   Option 1 : Issue the buyer a full refund.    -     This seems hardly fair as she insisted that she did NOT want tracking or a signature requirement for delivery. Option 2 : I can provide Tracking Information.     -    How can I do this when she insisted that she would NOT pay for tracking or a signature requirement. Option 3 : Provide proof that the buyer has already been refunded.     -   I cannot do this as I do NOT believe that she is entitled to a refund as she insisted on a non-tracked transaction !   So    ......... I'm stuck .........I cannot respond to PayPal's request for a response as the options do not apply and they say they will rule in the buyer's favour if I do not respond !  How stupid is that ?   Any ideas on how to resolve this .............I just find dealing with eBay and PayPal so frustrating and time-consuming and it really does my head in !  HELP !!!!!! ...
