Well, just as I thought there was no justice in this world I got a nice surprise from Paypal.   After fighting hard to overturn what seemed a crazy system, sellers allowed to sell virtual items but if buyers buy they are unable to obtain a refund.   Yay, I got a full refund which was by no means a small amount. But no thanks to the seller who wanted to hang onto the money because she felt she could do so.   I won't be in a hurry to buy anything from this seller ever again she was totally unethical.   Enough of that though, onward and forward.   Many thanks to the Paypal team as I'm sure my message must have somehow got through to the powers that be   Thanx again from a very relieved buyer. ... Who are the powers that be that I can contact directly rather than having to go through a one sided resolution centre?   Earlier today I received a notification that Paypal had closed the dispute. Several hours later I've received another email entitled Helping You through your first Claim. Does noone know what they are doing in this organisation?   I'd like a direct line to someone I can get some sense out of. So please let me know how I can do that.   Or are we supposed to put up with the ridiculous rules that Paypal keep changing at a whim.   Surely there is someone I contact directly? I don't think its a good enough excuse to say that Paypal don't cover virtual items. Amazon refunds digital products. It is just a cop out of their responsibilities to the buyer.   If they don't want to cover buyers purchasing virtual items then they should not allow a sellers to sell a virtual items. It should protect both parties. To my mind it is just allowing underhand merchants to get away with shabby offerings.   What you are saying there is not protection for the buyer but it's okay for the seller to fleece the buyer. I bought a web based publishing software with a training downloadable workbook. However, this publishing software was not fit for purpose and did not do what it said on the tin.   In fact the product was churning out gibberish sentences and most of the text could not be used for publishing purposes. After watching the sellers training webinar I discovered that she was editing virtually every line of text. If not editing it she was deleting it. Her claim that you could have the written articles or books done in two hours was not right. It was hard to understand the text let alone be able to edit it. The quality of the video was poor.   So a few days later I asked for a refund from her. She did not personally reply but  sent an automated response requesting I view her video to see the times she would respond to customers. She mentioned 48 hours on a very poor quality video which I could hardly hear. I sent out another request for a refund. She still did not reply only sending out her automated response.   I contacted her affiliate several times because I've bought a few things from him and found no reason to distrust his opinion. Though he contacted her and she told him that she would deal with it she never once contacted me. It started alarm bells ringing. I discovered by checking various sites that this lady was not returning monies to customers. She even deleted those requesting a refund from her off her Facebook account. Again this was sending out alarm bells.    I put this through Paypal Disputes a few days ago only to find that they said they could not deal with virtual items. What's more I don't understand how they can agree with the seller because the item cannot be tracked. It is crazy. The web based product was paid for via Paypal isn't that proof enough? Also she sells a work book which is a deliverable item.   Paypal make it very difficult to contact them and I think deliberately so because there are so many disputes and unfair and underhand dealings going on that they most likely can't cope with the volume.   In fact Paypal make sure that you don't have direct contact with them. For a big business it is shoddy treatment.   However, this is no way to let unethical sellers get away with products that are not fit for purpose and I'm sure there is something in law that claims this very point. They are most likely in breach of this law.   Paypal have passed over $597 to this woman and let her get away with selling an extremely poor online product. Their idea of expecting the buyer to negotiate with the seller is totally unrealistic as she completely ignores all messages and is hanging on to my money for which she has not provided any great service. She is to my mind amoral and unethical.55    So how do I get this money back since Paypal have just let her get away with a great deal of money at my expense?   Is there no American Ombudsman that deals with unethical sellers as Paypal seems to wash its hands of its responsibilities to buyers?   All Paypal has to say is go back to the seller and negotiate. The seller does not want to negotiate because she wants to keep the money as she feels she is entitled to do so.   I think Paypal have behaved in a very irresponsible way and are allowing the seller who is quite obviously fleecing customers to continue in the market place without first investigating them properly and checking the background of the seller. ... Tried the bank but they have said that they do not do a chargeback on something that was authorised by Paypal.   I'm going round in circles. So even if Paypal have this 45 day complaint window they are not allowing for a 60 day guarantee which  a lot of vendors now offer.   So Paypal have a phone number for the vendor on their payment transaction screen which is not recognised. How can they allow this? The vendor is not responding on any of the emails that it also has on its transaction page.   This is almost verging on the fraudulent. I do want to get a full refund and I believe that Paypal have a duty of care to its customers. Paypal contacted me via email to say that the vendor had called for a payment for his product. So in effect they have indicated that the vendor can be trusted though they do not have the correct information for the vendor on their site.   So please can you tell me how Paypal can take responsibility for their negligence in this matter?     ... Again apologies it seems like I am becoming a serial post stalker. Just tried the telephone number for vendor which Paypal has as point of contact. This does not work and is not recognised. How can he have a defunct telephone number on Paypal? This is not ethical.   I have gone to the vendors website and put in help desk request but his message box does not work so had to leave a few subject line messages. Got an automated receipt of those emails. Will see if he responds.   Waiting to hear from you how I can put in a complaint to Paypal when the Paypal complaint form does not work.   Cheers for all your help. ... View more
