Hello everybody, I'm in a situation where I don't know what to do. I ordered a mobile phone from jiayumobileshop.com It's a webshop specialized in jiayu mobile and accessories. It got good reviews so I ordered a black Jiayu G3 and a accessory pack from the shop. This was on 15 December 2012. On 17 December 2012, I've read their blog about only having silver phones and not able to deliver black phones. I used their contact form to send them a message about canceling a half order; I want a refund for the phone but still want to order the accessory pack. I got a reply back quote: (18 December 2012) Dear, I am sorry to remind you that for the jiayu G3 which come on 19th is all silver color, so can you accept the silver color instead, please advise us. Kind regards I've sent them a reply: (18 December 2012) Dear Customer Support, I would like to cancel my order because I don't want a silver Jiayu. I would still like to order the Jiayu G3 promotion pack. With kind regards, At this point, I've already ordered this phone elsewhere. This is the second time trying to cancel the phone. Their mail back: (19 December 2012) Dear, Let us wait to see, if we have the black color, we will send it to you. Kind regards Couple hours later I get another email: Dear, We will arrange the black color jiayu G3 to you in two days. Kind regards My reply back: (19 December 2012) Dear Customer Support, I would still like to get a refund for the Jiayu G3 Black. With kind regards, (Third time trying to cancel my order) Their reply: (20 December 2012) Dear friend, We have already arrange the shipment to you yesterday, it is the black one, but why you don't need it now? Kind regards Couple hours later, a shipment notice. I replied them once more explaining why I wanted to cancel my order en asked why they didn't cancel my order. (30 December 2012) Their reply: (31 December 2012) Dear, I am sorry, since now the shipping is already on the road, I wish you can receive the parcel quickly from us ,and wish you can like our product when you got it, have a nice day! kind regards Great... A little too late. Because it was a mobile phone with "high" value there was a chance I had to pay import fee. Should I get the phone without paying the import fee, I could always sell that phone (remember I ordered another exact phone). But with the costprice + fee, nobody would buy it from me. Today I got a letter from the post office, the package has been hold up by customs and I have to pay a fee around 40 euros. This is something I don't want. For that matter, send that package back and give me a refund. That's the tricky bit. Is this a solid reason to get a refund from the webshop using Paypal buying protection I tried to cancel my order 3 times! I got all emails saved except the first contact with the webshop because I used their onsite form (no copy was sent to me). I haven't had any contact with the shop since their last mail. What can I do? tl;dr - Pre-ordered a phone - colour I want not available - tried to cancel 3 times, order same phone elsewhere - They still sent me a phone in preferred colour - phone got hold up at customs - want to know if I can get refund.
