Firstly, i understand vehicles are not covered under buyer protection howver i would like to know if this case is different? I presume if you purchase a vehicle, pay via paypal, collect the vehicle and then go home you cannot open a dispute however my situation is different. I bid and won a vehicle for £3000 on ebay, as soon as i had won i emailed the seller asking for a paypal address to make payment of an initial £1000 (i had it in paypal and he accepts paypal as payment) and stated i would pay the remaining £2000 when it got collected within the next few days. seller told me this was fine and i sent the £1000 in the usual way stating that it was payment for an ebay purchase when i sent it. After this had gone through i phoned my collection driver to arrange collection and found out his vehicle had been stolen and that he was awaiting to purchase another which would be in the next few days, i let the seller know of the problem and expressed that i did not really want to use a collection driver i did not know or had not used before in case the vehicle was stolen etc and he was fine with that. After a couple of days i emailed the seller to say mmy courier now had a backlog and because it was 200 miles from my collection drivers base to the collection address it may take a couple of more days to arrange, with this i offered to pay the rest of the money i owed via paypal to show i was not messing him about intentionally (although £1000 should of been enough to prove that) and he declined saying there was no need and it would not be an issue. (this whole process has took maybe 10 working days from start to finish) there was no collection terms on the advert stating the vehicle must be collected in etc... no requests for deposits - this was purely my idea. I have logged onto ebay today and saw the vehicle for sale, it has been relisted with a nice comment stating previous bidder has not contacted me to arrange collection, and i have now lost contact with him so i am relisting - this is utter rubbish we spoke two days ago via email, now the question i have is can i get my £1000 back via paypal? i have not once told the seller i do not want the vehicle, the seller did not email me to tell me what his intentions were with regard to relisting, the seller has not once told me the vehicle is in the way, the seller declined further payments for the vehicle and now he is telling me out of my £1000 he will decide how much i get back after he has charged me interest on supposed money he has had to borrow to pay bills until mmy final paymemnts were made? what this has to do with me i have no idea, and surely if he was this short when i offered the rest of the money surely it should of been accepted? i am at a loss with this one,m i have been selling on ebay for ten years, i know most of the scams, i am not a scammer i genuinely still want the vehicle, i think he has just thought he can try it on. the vehicle did sell for less than i think he expected but with it being not road safe it would have to be collected and as its a two tonne vehicle any normal 3.5 tonne vehicle cannot collect it hence why i have to use a collection agent. finally i did not pay by credit card to fund paypal it was purely cash i had in there from sale. any help would be appreciated. thanks
