I have recently bought a new phone from a seller on ebay and paid via Direct debit from my bank debit card. I recieved the new phone (HTC Sensation XE with Beats Audio) from the seller minus the beats audio headphones. The seller has made no mention these are either included or not with the phone. The beats audio headphones are included in the box when bought via a contract, and are worth in themselves 90 GBP. When I opened the packaging the headphones had been removed and the box resealed, as I could see the wrinkles in the cardboard packaging inside the box. The item had been described as BNIB, and if this is the case, the headphones would have been included. See the pictures here The Item was sold to me as New: A brand-new, unused, unopened and undamaged item in original retail packaging (where packaging is applicable). If the item comes direct from a manufacturer, it may be delivered in non-retail packaging, such as a plain or unprinted box or plastic bag. The item description ommitted to list the headphones and memory card as missing, hence was misleading. I feel I have not been treated fairly by the seller, and am due a full refund. I have recieved a reply from the seller through the resolution centre in PayPal, where they have refused the refund, for 379.99 GBP and requested I send the item back to them for a full refund, with the possibility of an admin charge. They posted: Ecell Global LTD refused Thomas Roe's request for a £379.99 GBP refund. "We had completed this transaction to the best of our ability the exact item you bid for was shipped to you in perfect condition. Meaning before you clicked "buy it now" you are in agreement to everything that's listed on our advert, this is then a binding contract between seller and buyer. We always make sure that all our products are as described leaving no reason for customer's dissatisfaction. In case you would be returning this, you will be charged an administration fee depending on item's condition once we receive it back. For mobile phones we require that it is shipped exactly in the same condition it was dispatched to you, boxed, brand new (screen protector is on phone's LCD intact) and with complete, unused accessories (including product packaging, instructions). It should be in perfect, re-saleable condition, otherwise admin fee will apply. In addition, you have to make sure that there is no data stored on the device prior to returning. You are liable of all your confidential/personal information or files preceding the return of the handset.
