There is nothing you can do about any of it.  Join the rest of us who've been scammed and lost money.  Lawsuits don't help.  Appeals?  No.  Just learn your lesson and don't sell on Ebay. ... View more

You can sue anyone for anything in small claims if you present your case correctly.  As far as out of state claims, check with your State's small claims court division.  You will have to serve a person out of state, and verify their address.  That may be a challenge for you.    Why don't you just appeal the Paypal decision?  You can defeat an "empty box" scheme just by referencing your mailing receipt, which should list the total weight of the package.  If you can prove that your package weighed more than what an empty box weighed, you can prove fraud on the buyer's part.    $700 is a lot of money, so of course you should do something to get either your money, or your item back.  My new rule of thumbs for Ebay is don't sell anything on it.  Buy whatever you want, but never sell.  If you absolutely need to sell something on Ebay, then don't sell anything that you're not willing lose both your selling price and your product.  ... I won a chargeback.  Basically, the Paypal Sellers Protection actually worked for me this time.  I never had issues speaking with anyone on the phone.  Also, on another chargeback that I lost, the customer service rep reversed the $20 fee just to help me out.  I've had a ton of bad news about Ebay/Paypal, and while I still don't trust them to sell anything anymoer, I can at least say they did some good by me. ... You will not only have to refund him, you may not get the amp back.  Right now, you better be praying he doesn't file a chargeback.   If he decides to file a chargeback, Paypal will "freeze" the selling price of the amp for several weeks, which means it will deduct this price from your Paypal account, and you will have to resolve any negative balance before you can use Paypal again, which means you have to replace the money either with your credit card or your bank account (hope you didn't sell it for very much).  After they do this, you will get a notification that you have lost the case, and you will be hit with a $20 settlement fee.  No one will require that the buyer returns the amp, and you cannot appeal it.   So in essence, you will lose amp, you will lose the money you sold it for, and you will pay for the pleasure of it all.  And there's not a thing you can do about it.   Haven't you been paying attention to this board?  DON'T SELL ANYTHING ON EBAY. ...
