WE NEED YOUR SIGNATURES ..... The link and letter below......other petitions are also there do look around easy to find them...   PLEASE VISIT< SIGN< SPREAD THE WORD ~ Copy and paste the web addy and send to all people you possibly can   WE CAN PUT A STOP TO THIS IF WE WORK AND BAND TOGETHER !   http://www.change.org/petitions/ftcs-bureau-of-consumer-protection-investigate-paypal-ebay-business-practices# Why This Is Important This petition is to ask the FTC's Bureau of Consumer Protection to investigate Paypal & Ebay. Specifically for their business practices of holding customer funds, freezing accounts, and Ebay freezing accounts. Paypal routinely holds seller funds for 21 days while still expecting the seller to ship the item. No other store in the United States is expected to do this by their credit card merchant accounts so why are Ebay stores expected to do this? Paypal freezing accounts and holding funds for 180 days. Because Paypal is not regulated in the same way as a real merchant account, Paypal accounts are frozen for numerous reasons and without warning. Once an account is frozen , the funds are often held by Paypal for months on end with absolutely no recourse to the merchant. Paypal asks for personal information like social security numbers, credit checks, and copies of utility, cell phone bills. Just because a consumer signs a terms of service doesn't make whats in it right or lawful. In a court case Craig Comb, et al. v. PayPal, Inc it was found that User Agreement and the arbitration clause therein are unconscionable because they: (1) permit PayPal to issue binding amendments to the User Agreement at any time without notice to users; (2) obligate users to arbitrate their disputes pursuant to the commercial rules of the AAA, which is cost prohibitive in light of the average size of a PayPal transaction; (3) obligate users who reside nationwide to arbitrate in Santa Clara county, California, where PayPal is located; (4) permit PayPal to freeze and maintain possession of the funds in customer accounts until any dispute is resolved; and (5) require users to pursue their claims individually, and not via a class action. Taken together, the Court held these provisions made the User Agreement unconscionable, and appear to represent an attempt by PayPal "to insulate itself contractually from any meaningful challenge to its alleged practices." Notice number 4. Its for these reasons that we are asking that they be investigated as well as their terms of service. We are also petitioning that the Bureau of Consumer Protection recommend to the proper agency that Paypal be regulated like a bank since they seem to act as one. Furthermore since Paypal is a wholly owned subsidiary of Ebay we are asking that they be investigated as well. Ebay routinely freezes accounts when Paypal accounts are frozen whether Paypal had a legitimate reason or not. My personal account had 399 feedback, 100% positive, silver power seller, and top rated status. This creates a monopoly that is unfair to consumers. ... View more

I hear you Blaxo, I had the exact same thing happen to me! I have a feedback exceeding 1450, they "say "I have 4 -1's and 2's on shipping and postage only 3 can be found even when they look for them! I have a 1 day shipping and charge only what THEIR postage calculator showed, the last time I paid out of pocket 3.85 as it was wrong on the s/h cost to the customer. They told me I need to improve my s/h practices and give FREE SHIPPING along with giving me a canned answer ever time I asked a question, usually saying "We are happy to see you have been an Ebay customer for over 6 years and would like to tell you thank you" I in turn told them they could F' them self, their rules, their fees and them self! I then immediately went to my store, ended all of my listings, closed my store and have now gone to another selling site with FIXED selling costs and rules that are layed out in simple English and not 1001 ways to **bleep** the seller that is raking in the bucks for them!  I AM, R E P E A T AM looking into hiring an attorney to file a suit against them in a class action means as Ebay and PayPal are TWO SEPARATE entities and one can not control the other as they are having it do now. Ebay even put a freeze on funds that were in my PP acct that were NOT even from anything to do with FEEBAY !  I can't wait as I am sure many others feel the same when we THE PEOPLE that made them what they are get our justice for them playing games constantly with the sellers, US. Do your self a HUGE favor END YOUR ACCOUNT ASAP,  AND take your business TO ANOTHER SITE THAT HAS ONLINE SELLING , STARTS WITH   TI_S , 3rd letter is what starts the fruit that keeps the Dr. away ! You will be happy you did, I am not happy I did I am ........ THRILLED I DID ! Just upset I DIDNOT DO IT SOONER ~ LOTS OF SELLERS ARE ABANDONING SHIP AND heading for the isle of safe harbor with sites that are a bit more fair to the sellers and not so presumptious that the seller is always doing something wrong with their child like  5 star system that they grade us with, they can shove the 5 points where the sun don't  and WON't go! ADIOS FEEBAY! ... View more

You are exactly right we are to get the funds we are promised as are Ebay and P.P.,  so why are the profits we do make being taken by P.P and EBay simply for allowing us to list and sell the items we have, The more expensive the items are the higher the fees become to list as well as final fees not to mention the fees for P.P.  Why can't they take a set fee to list the items regardless of the final selling price of the items? I agree they should make some money as well but why should they be allowed to keep increasing the rules, adding senceless fess and still act as though they are the law as far as what and how things are to be done, the time frames allowed to do them etc.  Simply put pay for what you get but at the same time leave a little bit for the sellers. Many other posts break down exactly how much is taken on a simple $1.00 sale when all the numbers are crunched it leaves little more than crumbs for the ones actually trying to make a few bucks here and there. I have stood back and take a  good look over the last 6 years selling and finally decided that enough is enough.  Being tolds that one needs to improve the way they write a description, really? I give more details in my listings than many give in ten listings combined yet they give a grade tro the seller if the "buyer" or those that be look over the feedback and decide it dosent meet what "they" feel is good contact etc. I palso buy my postage online with Ebay, the tracking is automatically loaded and sent to the buyer, feedback is given as soon as shipping is sent out, my items are sent the same or nextr day if the mail has ran already for that day and yet I NEED TO IMPROVE MY CONTACT WITH THE BUYER AND SEND IN A MORE TIMELY FASHION, oh please ! OH AND YET TO SAY THEY TELL ME i AM CHARGING TOO MUCH FOR POSTAGE? I DO NOT CHARGE ANY HANDLING FEE AT ALL, I PAY FOR ALL INSURANCE AND YETR I NEED TO LOWER MY SHIPPING FEES AS THEY ARE TO HIGH! REALLY ? HONESTLY ...REALLY ? DO THEY EVEN THINK OR KNOW WHAT THEY ARE SAYING?   NO I THINK THEY ARE THE ONES THAT ARE TOO H ***h ! ... View more

Newbies and NEGATIVE feedback, get a grip PLEASE o...

There has to be something done befor itis entirely too late regarding "Newbies" to ebay . I hope that I am speaking for many of the "experienced sellers"  regarding the negative feedback. How many of you have noticed as I have and actually done some fairly lengthy research of many many many of the sellers that have high feedback numbers but do not have a 100%, NOT necessarily by any fault what so ever of the seller. Specifically I as many other sellers are buyers as well. When deciding to place a bid or to do a Buy it now I do take a glance at the feedback score, as unfair as I feel they are as honestly so there are some sellers that honestly do deserve the negative rating they receive as I am not saying that all sellers are persfect as we know  that is not possible by any means as each individual buyer has their own expectations of what exactly they expect, some reasonable and some not so much!  What specifically I am getting to is I have noticed that when a  feedback score is less than a perfect 100% I do take a look to see the reason as I am sure many do, this alone by haveing a less than 100% is not a deal breaker for me to decide that I choose to not do business with the seller.  I can say that after 6 years  on Ebay that a very high percentage of negative feedback is given by "newbies" , take a look at random sellers in various catagories and you will see exactly what I am referring to.  I know many of you reading this are wondering what does this have to do with PayPal? Please, let me take a few moments of your time to explain. After coming to realize the fact that MANY of the negative feedback scores come from the "newbies" I had often wondered WHY there were not some type of a filter or some type of process that a buyer would have to go through to be able to post a negative feedback.  Many of the negative feedbacks are given to sellers that have a long track record of both buying and selling but it is the selling that is the point of concern for me on at this time. As a seller we are not able to give a negative feedback for a buyer regardless of how much trouble, problems the cause, case they open against us as a seller over a specific item, slow in paying, on and on as I am positive that each seller has had their share of buyers that looking back they wish they had never had bid or buy their items just becouse of all of the headaches they give and yet we are to give 200% regardless of what they do or say to us and what  roadblocks they pose for us to give them the "expected" perfect transaction. regardless of how hard and diligently we strive to give such . Do yourself a favor and start taking note of the negative feedback scores that you see and how many are from buyers with a less than 300 feedback. If as a seller we do not leave the POSITIVE feedback as that is our ONLY option other than not leaving any at all then we are considered to not be compliant in completing the sale so there we are once again as sellers as we have no other options available to us, a rock, ebay / P.P and a hard spot take your choice! One would think with as much as we all pay in fees they could hire someone to figure out that there  should be some type of limitations or requirements for the protection of the sellers, why is  the protection for BUYERS ONLY on feedback?  You ask what does this have to really do with P.P or Ebay? Let me tell you. IF a seller is able to get and retain a 100% feedback score that COSTS both EBAY AND P.P MONEY! How you ask, With the 100% you are now given the PREFERRED SELLER / POWER SELLER badge ..WOO HOO!  Thats a huge plus right ? In getting and obtaining a sale of the items that WE as sellers purchase and list ( oops ! and PAY to list) . By obtaining the Power Seller Badge we are given a VERY generous discount on shipping  ( but it is made up in other fees they now charge us)  So this in "effect" costs Ebay and P.P $$$$ by giving these minute discounts on shipping costs BUT ONLY if you use the online shipping! By BOTH Ebay and P.P. in conjunction with each other itis beneficial for Ebay to make it even more difficult to achieve such ratings as it is to their benefit to hand out as many obstacles and rules making it nearly impossible to achieve and if ACHIEVED TO KEEP THIS RATING, the benefit for them you now ask? They no longer will give you the "ever so important" badge and along with that you "BAD SELLER< NO DICOUNT!" also pay a higher fee! A higher fee is money in the bank for both Ebay and  P.P. So bottom line is this ...WHO  IS BENEFITING ? With more and more rules making things next to impossible to do business on line they will soon start seeing people leaving with, more Flea markets popping up, Craigs List getting busier ( DID I mention ...NO FEES HERE!) Ebid, Bonzel and many many more sites all taking the market share in time if  someone dosent stop and remember it is the SELLERS that keep this site going !  NO successful business ever kept its door open by taking and taking and not giving back, saying thank you to the main supporters that keep the doors open no the listers with NO STORES that ONLY use the site for the 50 FREE listings and thats it. Ok EYES OPEN AND TAKE A BIG LOOK at the ENTIRE PICTURE PEOPLE ! And NOW they want to charge us fees on the postager that the USPS charges us, in effect they are working as a broker for the USPS and reselling their service as it is used inconjunction with the ebay site, we pay pay pal for the postage etc. Get the idea ???  Is this NOT illegal? I truely and STRONGLY beleive that Ebay and P.P are both in kahoots with one another as one scratches the back of the other by knowing the USPS has RAISED THE RATES OF POSTAGE and NOW charge us a percentage of the cost of shipping WE GET NO BENEFIT of the postage paid but Ebay and P.P DO gesh I wou]nder WHY they would ever think of charging the sellers a percentage on the shipping cost too? LOVE the velvet lined gold encrusted diamond studded pockets that are so deep you would need an oxygen tank to reach the bottom  of thier pockets, so ... charge fees on Postage, make it harder to meet "their" requirements so as to charge HIGHER rates by removing Power seller and Preferred seller badges,  easy and no reprocussion for negative feedback, from buyers causing feedback scores to drop = HIGHER fees, who is making it and whi is getting a ROYAL .......! Anyone know of an attorney to look into these  points , a  possibility of a huge class action with a REFUND to all of us that have paved the driveways of Ebay and P.P. in gold for so many years!  Look on Google search and you CAN find processors for Credit cards  and debit cards ELIMINATING the need for P.P. I am looking in to it further and what I have foundis it is MUCH less than what I am paying NOW! and NO ONE taking control of my account, freezing MY MONEY and telling me I have to do this and that or I will be "punished" I am a big kid, really I am and I think I am quite aware of customer service and how to run a business, I have only been in business for the last 29 years! I dont need either of them being my BIG BROTHER ! ... View more

CASE 1- I can't believe there is such favoritism shown against HONEST sellers that are treated as a thieving scam artist and con men by BOTH PP and EB !  Sell an item showing absolutely EVERY ASPECT of what is to be included when received, stated NO REFUND 3 separate times,  to ASK QUESTIONS AND FOR ADDITIONAL PHOTOS PRIOR to auction end as after close of auction is a bit too late, absolutely no request was made by buyer that jumped in on an auction end with 3 seconds left, he won and paid before I could send the invoice within 5 minutes of auction ending, I let it go and absorbed the difference for shipping and insurance. Buyer receives the item and then complain that it is not in working order and is not complete which was CLEARLY stated 3 individual times and opened a case  PP froze my account the guy ended up winning as he stated I was a fraud and did not disclose the item condition which may I remind you WAS done 3 times! They refunded his money including shipping BOTH ways and he still had the item, I received it  2 1/2 weeks later wrapped in trash and garbage and HE broke the glass and bent some metal inside the item and I am the one that had to take the hit on it costing ME close to $60.00 for shipping to and from him AND EB found in his favor even after saying everything was clearly disclosed but the buyer is always right  as he may not have seen the details I stated ! WHAT THE H**L !!!  I was able dispute the win and the decision was reversed " this one time only" as quoted by the CSR, due to the buyer damaging the item and agreed to reverse the claim and repay me but did NOT REFUND the shipping either way that I PAID! But PP kept my account overdrawn, sending me notice after notice to pay them before the case was ever decided for 3 days after saying I would be refunded.   CASE 2 - I packaged the item and sent it the day payment was cleared, the Post office DESTROYED the package, buyer said it was NOT my fault at all (my feedback commends on my packaging items well) I told buyer I would work with her as it was insured and would IMMEDIATELY start the claim, buyer said she doesn't reply to emails so I was forced to have to call her each time to let her know the happenings all on MY DIME! I REFUNDED from my account same day and waited to be reimbursed by the USPS. I have her on my vice mails SAYING "ABSOLUTELY NOT MY FAULT AT ALL.! " SHE THEN GIVES ME A NEGATIVE FEEDBACK! Now due to these 2 instances I am notified that I am on risk of having my funds held by PP, HOW IS THAT FAIR? And how can they just arbitrarily decide to hold MY money for MY items I sell until THEY (PP) decide all is fine and no problem for the buyer. Are they going to pay interest on MY money? NO WAY that goes into their pocket and they get to use MY money for their needs, HOW IN THE **bleep** IS THIS FAIR AND THEY TAKE FEES ALSO !  NOW, I hope someone is able to explain to me why that, IT IS NOT CONSIDERED TO BE DOUBLE DIPPING BY USING MY MONEY AND CHARGING ME FEES? I get to send the items out, pay the shipping and NOT be paid until EB AND PP decide to release the funds that are rightfully mine but to be given / released to me at their discretion! I ONLY HOPE TO FIND ANOTHER VENUE TO SELL AS I AM FED UP BEYOND BELIEF WITH THE B.S BOTH EB AND PP CONSTANTLY ARE PULLING, RULES CHANGING ETC ETC ETC. AND THIS IS HOW YOUR TREATED after being with them for over 6 years AND  paying for a store with NO 50 free listings as "you" have a store front as they say, ALL of their rules and do this , don't do this, give this , give that but WHAT DOES EB or PP GIVE US besides a royal SC&^%ING ? And that's being "nice" as to what they give us... US that support them and pay all of the BS fee's for the big guys to sit in the offices and collect a check to decide how to **bleep** US JUST ONE MORE WAY !    AND lastly....... E.B and P.P when do I get my kiss as you did NOT even  take me to dinner   DOES ANYONE KNOW OF A SITE TO SELL THAT IS FAIR ? IF SO PLEASE DO LET ME KNOW AND I WILL BE THERE TO SELL CLOSING MY ACCOUNT AS A STORE FRONT AND USE THE FREE OPTIONS ONLY, ISN'T THAT WHO THEY TRULY WISH TO CATER TO ????? And lastly,THANK YOU  for reading this post, there will now be a fee you will be charged by BOTH E.B. and P.P,  You don't like the fee that has randomly been added? TOO BAD , WE DON'T CARE ! Isn' that the attitude they give out? ... View more
