what can i do

hi can anybody help,irecently saw a campervan for sale on ebay i contacted the buyer who asked me for a £200.deposit and the van had no tax so i asked him to tax it ,i sent him a further £118. for the taxwhen i went to see the van it had no power steering and a couple of other things that i was not happy about.i told the seller i didnt want it and asked for my money back he refused i offered him £12. to relist the van and £50. the deposit he was asking for at the end of the auction,also to send the tax disc back to dvla and i would wait for the refund,which he agread to ,since then i opened a dispute on paypal.today i recieved a email from paypal basically saying tyey would not be taking any action at this time,they would put this on the sellers profile for future ref.so where does this leave me .itleaves me £318. out of pocket and i believe that by paypal  not taking any action against the seller lhe has just got away with it scott free.if anybody with any knowledge of the law can give me advice on what to  do now i would be very much obliged.

You should never pay anything for a motor vehicle until you have seen and examined it preferably with a mechanic.

 

Paypal protection does not protect you for motor vehicles and personally I would never use paypal for these items, cash on collection only.

 

The problem you have is with the seller but you agreed to a deposit presumably non refundable. If you feel you have a case feel free to pursue this with the small claims court.

Hi ,thanks for your comments ,on the ad for the van it did not state the deposit was non refutable . He agreed to me paying him for the £12. For the relishing fee and the £50 deposit he wanted at the end of the auction. He now says he is not paying anything backpackers under the consumer rights bill i have the right to change mind.i would be gratefull for your thoughts.regards nazthedog1.

As i said before yes you may well be entitled to a full refund however the only way to force him is via a small claims court.

 

Tell him that if he does not refund you fully you will be pursueing him via this route that just may make him reconsider.

 

Also if you want more advice try trading standards. 

 

Finally if you fund your paypal payment with a credit card it may be worth while contacting your c.c. company and asking if they can do a chargeback for you.

hi thank you for your valuable advise i have already threatened him with the small claims court,i shall try the trading standards. once again thanks for your advise ,its nice to know there are still decent people in this world.
