I recently purchased a winch. The person I bought it from emailed me and said they were broke into and most there inventory was stolen. He said it was going to be a couple of weeks before he could fill the order. I responded that I was not in a hurry. It has been a couple of weeks and no response. My question is since I haven't received the winch yet does he get paid anyway?

Unfortunately he's already got your money. You should have immediately requested a refund. Note, per PayPal's User Agreement:
If you wish to open a Dispute through PayPal's Online Resolution Center you must do so within 45 days of making your payment.
If you're past the 45 day window, your other option would be to contact your credit card issuer for advice and/or assistance, assuming you paid with a credit card.
