what if seller dosn't cooperate?

If a dispute for a faulty item is opened, and i get asked to send the item back to China, but the item gets as far as the sellers front door, but the seller dose not claim it from the postal service (tracking informations tells me that if it's not claimed, it will be sent back to me) how can paypal possibly help and refund me?

 

please see my previous post (11th November) I still havn't had a reply to.

I apologize for the delay in responding to your request and you pose a great question.  In your situation you would still typically be covered provided that the following occurred:

 

1.  You shipped to the address PayPal authorized you to ship to.

2.  You have tracking showing either delivery or attempted delivery.

3.  If delivery could not be made whether it was the seller refusing to accept or other issue, we will ask you to supply a Proof of Purchase.  This is the Customs form you filled out that shows the exact address of the recipient.

4.  As long as we can confirm you have shipped to the authorized address and that an attempt was made to deliver the item back to the seller, we will still award you the funds regardless of whether actual delivery was made.

 

Essentially, the seller is responsible for ensuring they provide a valid return address and that they are willing and able to accept the merchandise.  As long as you have done the things we require from you we will refund you in full.  I hope this helps ease your mind a bit and I wish you a great day.

Thank you for this information. However, i did re-email the seller to check if they had received the item yet, and yesterday i got a reply saying that the seller has now collected the item and will let me know if they accept to refund me as soon as the item had been checked.

 

The trouble is, that the seller was not willing to refund me until i opened a dispute, then he had no choice than to allow me to return the mobile phone watch.

 

But i'm now concerned incase he claims that i have damaged the item, when in fact i had taken great care not to damage it and not use it, i kept it in it's box right from day one of receiving it as it did not function correctly and it was still in prestien condition, so what if the seller tryies to get out of refunding me if he lies and  claims that i had damaged it?

 

there is no way to proove that the item was perfect when i sent it, and this is concerning me as the seller seems to be taking a very long time to cooperate and refund me.

 

please advise thanks

Thank you for your reply and I understand your concern.  If you have online tracking showing the item has been successfully delivered back including a signature, if applicable, then the case will be closed in your favor with a full refund.

 

The refund is not issued by the seller, as PayPal will be the one to issue the refund on behalf of the seller once we have confirmed delivery.  If the seller claims the item is damaged they do have the right to appeal the claim but typically this is not going to affect your refund.  Based on the information you have provided I believe you will be fine and I am hopeful that your case will be reviewed soon.  Take care.

The seller has received the item i sent back and has had it for about a week now. The tracking number tells me that the item was received.

What happens next, as i haven't heard anything from ppl since.

could there be a problem?

 

The seller told me that he'll want to test the fault on the phone for himself when he receives it back, so what if he offers a repair instead of a refund? i would much rather have a refund.

I am not clear on what the status of your case is but you can view this in your Resolution Center.  If it says in 'Review' then this means the case is waiting to be reviewed by the next available agent.  Cases are worked in the order they are received and we do work them as quickly as possible.

 

The seller can test the item if they choose but as they are not the one that would be issuing the refund it should have no effect on your case.  You are not obligated to take a partial refund or have the item repaired.  If we instructed you to return the item then you would be receiving a full refund once we have decided that we have everything we need to close the claim.
