my disputes doesn't have an escalate to claim option

my account was recently hacked, and a large string of money was sent to a few emails. I disputed it and got some of it back right away, but there is still 5 cases from 1 person that is still awaiting on his response. i emailed him and he has yet to respond and its been over 3 days, i was wondering how do i escalate this to a claim because i followed the paypal guide and the only option at the bottom of the page is "return to transaction claim and disputes". this whole issue put my bank account into an overdraft **bleep**, its currently around $(-600) and its really **bleep**ing me over for rent.
