Does PayPal Condone Theft?
 

I am confused about the process PayPal takes when HELPING sellers dispute a claim. I have a buyer who states the item was significantly different from the one described (which is wasn't), but she REFUSES to return the item to me. I have emails that I sent to the "PayPal Dispute Specialist" where the buyer has eluded to the fact that she has NO intentions of returning the item.

 

I have been told there have been cases where the credit card company allows the buyer to keep the item AND issues a refund! Say What? This is definitely a scam, and I am NOT satisfied with the process of "protecting the buyer". Has anyone else had this issue where a buyer has reveresed the charges on their credit card and DID NOT return the item? I need HELP and I don't want to hear about the POLICY. The buyer has comitted a crime and I just need to know do I sue the buyer or PayPal?

10.1 Your Liability. You are responsible for all Reversals, Chargebacks, Claims, fees, fines, penalties and other liability incurred by PayPal, a User, or a third party caused by or arising out of your breach of this Agreement, and/or your use of the PayPal Services. You agree to reimburse PayPal, a User, or a third party for any and all such liability.

 

Liability for PayPal Claims. If you are a Seller and PayPal makes a final decision that you lose a Claim filed directly with PayPal, you will be required to reimburse PayPal for your liability. Your liability will include the full purchase price of the item and original shipping cost (and in some cases, you may not receive the item back). You will not receive a refund on your PayPal fees. PayPal Seller protection may cover your liability, see section 11 below.

 

You sue no one and accept your losses unless you want to spend more money in court.  Does that answer your question?

I would appreciate if you stop posting to my comment. I want to speak to people who have endured a situation similar to mine. I desire to know HOW they resolved it! Please take your user agreement jargon and grind it in a garbage disposal! That's the nicest way for me to put it! Thank you and please don't post on my thread again!!

Check this out. The buyer.. while having a dispute within Ebay quickly uses the PAYPAL Loophole of having his money refunded without EVER CONTACTING THE SELLER!. PayPal DID THIS!. I have been in a dispute for over one year and never once, even after numerous phone calls, has PayPal contacted me to resolve the issue. Now, I am about to file suit against them for breach of contract as well as additional charges that should be substantial. It's upsurd. The buyer has the item and the Money (thanks to Paypal). I can't believe that PayPal can do that without contacting the buyer. They are very liable for this so don't be fooled. If I had purchased an additional service from them I may have been safe but I dont know for sure. Regardless, if you cant get anywhere you have no other choice if you want restitution. Now I am an SEO professional so you can imagine the changes on the web that are going to occur at the end of this. I probably will start a site.

 

Check this out.. no one ever called me ONCE even after at least 10-15 requests.. I get the following letter.saying some guy named Philip tried to contact me (of course this right after I have no choice but to file suit in order to get my product or money. . read below the way the automated system just throws back this reply.. there is no help from Paypal. They intentionally thwart you from receiving proper restitution. I"m really done with them... I will suit for damages and win if they dont respond to this! by the way. It's my birthday. Thanks for the grief paypal!

I appreciate your attempt to contact me. I have never received an E-mail or Phone call from anyone at Paypal, including yourself, until now. So I'm not sure what attempt you believe you have made but I am very much looking forward to any help Paypal can provide.
 
After more than a year I have not been able to contact the buyer. He simply will not respond. There was a dispute going on within the Ebay system and he quickly went to Paypal and had his money refunded without Paypal ever contacting me. This was after numerouse requests from myself to do so. Since then, this is the first response from anyone in your organization over a year. Thank you for that.
 
Moving forward: I hope you're organization is willing to help. Perhaps I can finally speak to someone personally and we can get this issue resolved.

Thank you for sharing your incident with me. It disgust me that people are being robbed LEGALLY and using this "trusted" site to do it.  I am just trying to discover my options- I have quite a few in my arsenal. I don't care what the user agreement states. The process is legal theft. I am glad you filing a suit. I know some people contact their district attorney. Have you does this, or heard a user say they obtained results from the process. If the credit card company doesn't decide in my favor, I will complete a police report and file a formal Internet theft complaint. The producers of a famous judge show have already contacted me and are ready to take the case.

 

I have also contacted two media outlets in my city and they are WILLING and SOOO Ready to air the story.  I am thinking about contacting a national news affiliate because they can rally more people to draw interest to this problem. This is obviously a practice that is catching innocent people off guard. This READUSERAGREEMENT person is a paypal employee in disguise, so I disregard anything this person says. Please don't give up...I know I will not stop fighting this issue!

If i was a Paypal employee i would have a cool Paypal thing in front my name duh.  I dont work for Paypal I dont use Paypal I simply understand the risks involved with Paypal and unlike many people here am mature enough to accept and understand said risks. 

 

theatre_junkie  You got the short end of the stick, get the bleep over it and grow up. 

 

Also read the user agreement before signing up for Paypal because I know you didn't.

Sue Paypal,, why - it's the credit card company that allowing the buyer to keep the item and money, not paypal.

Paypal will not release the credit card company's name. Have you have a situation similar to mine? Did you sue the credit card company? Please provide the details on how you resolved the issue.

Hi I am in a very similar situation to yourself, I sold an Iphone through eBay in which the person obtained the goods and then quickly applied for a refund in which PayPal (happily) refunded automatically witout contacting myself at all!! eBay then found the user to be fraudulent and closed there acount off. I have reported this as a theft to the police and have contacted PayPal numerous times (unhelpfully) who seem to throw jargon and terms and conditions at me at all times!! Even the police have said not to pay PayPal as they are the ones liable and have let this to happen. How can they justify refunding a person money when they have already obtained my goods and have not returned them it's ridiculous and not contact the seller as to resolve the issue??. And also if what they call a 'personal payment' is oh so easy to understand when they email to you they should make there fraud investigation team better at finding people who are scamming innocent eBay sellers. 

 

I have now passed this on to the police who are getting in contact with PayPal who have threatened me with a debt collector if I refuse to pay them back the money!!!

Paypal does not just give people refunds!  You either lost a SNAD claim INR claim or the buyer filed a reversal through their bank or a chargeback with their credit card company now which was it? 

 

What matters is you lost claim or the bank/credit card company filed with their customer/card holder.  The paypal user agreement clearly warns you about the risks of chargebacks/reversals, how can you be surprised?

 

You also (by signing the user agreement) are liable for the negative balance and you should pay paypal back before they send you to collections. 

 

Oh and the police wont help you
