HI everybody !
I am a new buyer on ebay and this is the first time I have ordered online. I ordered a music dvd from the seller "chicksone", but she told me that the item I wanted to buy was out of stock so she asked me if I could wait for her to import some more from Japan and I said yes. She already charged me. On May 26, 2011, the transaction appeared on my bank account and $ 46.79 was taken out. Today is July 7, 2011, and I haven't received anything yet. I have mailed her a lot and she hasn't replied me. I consider this is a fraud. My eaby item number: 250817928989.
Please help me!

P/S : I already tried to call to ebay support customer, but I am Asian so it is really hard for me to listen in English

1. You should have used the iTunes store or bought the CD from a local retailer...
2. You should open up a case with her on paypal stating that you didn't receieve the item and you should state that she hasn't replied.
3. If you didn't use paypal for purchase and you used a credit card or something then you have just probably lost your money.
4. If after 2 weeks she hasn't responded you will automatically get your money back. You will have to wait for her to provide proof of postage, if she does, and she provides a tracking number you will not get your money back, but you should get the item.
5. Are you sure you waited long enough? Postage takes forever, especially when asking to import things to her and then send to you. You should have asked for a refund and gone somewhere else, it's always the faster, safer option.
6. She could be busy you know, some people are far too busy to check their emails.
7. Never, ever post another persons username on here that you believe has scammed you, it's against the rules.

Thank you very much for your advices. Yes, I used paypal account to pay to her. I already opened a dispute case. Like you said maybe she is too busy, but when I mailed her about buying her item, she replied me really fast. Just recent weeks, I've mailed her because I haven't received anything and asked to refund, but she hasn't replied. One more time, thank you very much.

Tell paypal exactly whats happened, be really descriptive. She will have to reply within 20 days (I know its a long time). If she doesn't you automatically get your money back.
If you feel she is not replying fast enough you can escelate it into a claim stating that she is not replying, not trying to help resolve the issue. If she is away on business or too busy it doesn't matter she is still 'in the wrong' here. So you can make it a claim.
Then she has 10 days after you tell Paypal exactly what happened to reply, if not she gets a black mark on her account for not replying and you get your money back.
Up to you what you want to do. Just make sure you tell Paypal what happened.
