Can a refund be processed by Seller if you have an open dispute with Paypal - Buyer protection

Hi

 

I ordered a mop, bucket and mop mat with express delivery. After waiting nearly 8 weeks I received only the mop mat - useless to me 

After many emails back and forth, I lodged a dispute. Many more emails and they have finally agreed to refund 100% BUT have advised me they are unable to process the refund while the dispute is open. I am very wary and dont want to close the dispute before I receive a suitable outcome (full refund)

 

Is this legit or am I just being spun yet another lie? I would have thought they would have been able to refund no matter what the status of the dispute case?

 

Many thanks in advance for your input as I cant find the email address in order to ask Paypal directly
