Can't open a dispute after 45 days deadline was missed

Hi there. I need some help. Here is the problem:
Item I have purchased on eBay never arrived. I tried to resolve the problem within direct conversation with the seller for the last 3 weeks. They were buying time, changing contact persons, suggesting to check status of the order with MY customs and postal office, asking me to provide detailed order description, my contact info etc. As result the 45 days time limit, since transaction has been made, was up and - it was my mistake - I have missed that moment. The seller now is not answering my e-mails, standard Pay Pal methods for resolving such problem are not applicable since the 45 days deadline has paste.
If anybody can, please advise what to do
