Long story short, I purchased a used moncler item on a site called grailed via paypal. When I received the item, it was a blatant fake. I opened a case a few weeks ago with all the evidence. An official email from moncler authentication team saying the item is a counterfeit. A moncler buy sell facebook page with 10 000 members with multiple individuals quoting the jacket as a replica. And a moncler authentication forum with info that clearly show my item as being fake. Clearly the item is fake and paypal has accepted the item to be a counterfeit. Here is the problem. Paypal wants me to send the jacket back to the seller. The frustrating scary part about this decision is that it is illegal to send counterfeit packages via mail outside the country. You can go on Canadapost for more details. There are import laws in the sellers country Romania that also prohibit the import of replicas. Paypal is now forcing me to commit a crime for me to obtain my refund. Not only can the item be seized in my country and as well as the sellers country, which means I will now get my refund since the seller will have not received the product. But also, the Canadian Border agency will hold the product for the company that holds the rights and integrity of the item, in this case moncler, until the company can take legal actions against me. Not only will I be fined and or if not detained by the CBSA, I will be in a legal lawsuit with moncler. I will post evidence of me destroying the item in my possession and sign any waivers or contracts that outline that I have destroyed the counterfeit item. It just seems very odd, disappointing, and frustrating that paypal is making me commit illegal actions for me to be guaranteed buyer protection. On the other hand the seller is not punished and loses nothing for selling a counterfeit item which is obviously illegal, unethical, and goes against paypal guidelines.
