Transaction:
I had recently bought a phone through Swappa. The seller described it was in "mint" condition, but when i got it, it was covered in fingerprints and oils. It noticeably had some light scratches on the screen as it looks like it was never used with a screen protector.
After I received the device:
I alerted the seller and the swappa team, and the seller agreed to send it back. So I went ahead to pack it asap, I couldn't catch my local post office window because they had closed that day, so first thing in the morning, I handed it off to be shipped. I had pre-printed the label with insurance required and a tracking number. I just wanted to hand it to a person in USPS and describe that it is a fragile item.
-- I was told to open a PayPal dispute and post the case number on swappa sales page, so I did. Messaged the seller there as well, and the seller responded that he/she will do a refund right after they receive the device in its shipped condition.
After the return was "delivered"
I posted on the sale page to let the seller know that the tracking number shows it was "delivered to agent". He responded back and said he didn't get it. The local post office was closed by this time, I called first thing next morning, and they said that it has been delivered for sure "the person on the phone called the carrier to check personally, and was told that the mail carrier had gotten a verbal agreement with the person receiving the phone to put it in their mail box if it has signature required, because that person has a camera, and the signature shows the "GPS coordinates at the time of the delivery". I have a signature, but I believe that the mail carrier "person who is delivering USPS packages" signed themselves before dropping the package off.
Now that I have gone to my post office to check how to go about an insurance claim, they said if it shows "delivered" and was not lost/damaged during shipping, my claim my be denied.
A few things/facts:
- After I told the seller that I called their USPS office and explained the situation and for him to call/check. He said he would, but I never heard back from him.
- I have left a few messages and the seller is not getting back to me whatsoever. I also left a message on the PayPal claim page, and did not hear back from the seller.
- I put my "P.I." hat on and found that the seller has an online activity else where on another website but he is ignoring me.
- I have not escalated the the PayPal case yet giving the seller a chance.
The big question:
What do I do here to ensure I get my money back? and did I do something wrong?
