I sold my rolex oysterdate last month on a platform similar to ebay which used paypal goods and services. All went well and the seller was happy with the watch. Last week he sold it to a jewellers who send the watch off to rolex to get an extra link. Rolex then confiscated the watch on the grounds that it had been stolen. The jeweller is legitimate and has the letter from rolex in hand. The buyer has filed a claim and paypal are currently revieweing it. I personally believe that I am not liable anyway as it's always a risk of buying a watch without papers and history. Plus, there is no public list of watches that have been reported as stolen, so there was no way for me to check. Unfortunately I think paypal may still side with the buyer. This is where the buyer shot themself in the foot- when I initally disagreed with them via messages on the selling platform, they sent me several threats includuding "I'll bash your door down" and "I'll smash your face in". They also sent names of family members and my address to intimidate and threaten me. I have photographic evidence of all messages, plus I have submitted a screenshot of section 51 of the 1994 criminal justice and public order act. What I'm wanting to know is: 1. would paypal refund him if he can't return the watch (because rolex confiscated it). 2. If I state that he's commited a serious criminal offence directly related to the claim, would paypal side with me regardless?
