I've recently submitted a claim about a laptop that was sold to me with the wrong charger (leading to possible damage, not observable damage yet). I have lots of evidence to support my claim and have tried gently negotiating with the original seller over eBay. I've escalated to a claim and am waiting for paypal but in the meantime I have a few worries: 1)The seller, upon discovering that I even disputed it over PayPal is threatening me to cancel the claim if not he would not give me the correct charger. Previously, he agreed to give me the correct charger in 2-3 weeks time, however I thought it wasn't enough and decided to bring it up to PayPal and see what they say. He has been aggressive in his messages and has started name calling and said that he will never refund me and that he's accusing me of damaging trying to cheat him because I "damaged" the charger. Although I gave him pictures CLEARLY demonstrating that the charger is the wrong one, he ignored it. (It might be he badly misunderstood me since it is apparent that English is not his first language) ANYWAY, my concern is this: suppose paypal rules in my favor and gives me the refund if I return it. What if the seller chooses not to reveal his return address so that I cannot return it? And if I cannot return it, I wouldn't get my money back. With his current tone, I am confident that he will do anything he can to block the return. Will PayPal be legally able to provide me with his address to post the return in this case? 2)Given the sellers hostility, suppose I do return the item. Can he claim that it is damaged and claim for a refund of the return? I would never abuse the buyer safeguards to return a product that I damaged, but I'm uncertain as to his capabilities: If he intentionally damaged the laptop upon return and took a picture of it and sent it to paypal, it would certainly pressure me. What can I do to avoid this? I thought of recording a video of the laptop in full functioning condition before sending it back if I do win. Would this work? 3)Would the Seller be able to take further legal action to challenge PayPal's decision? I am a student and a laptop is of massive importance to me. I will immediately buy another one with the refunded money. My worry is that if he takes other legal actions e.g. (small courts, cc chargeback?) he would be able to delay the refund for a significant period of time, preventing me from getting a new laptop which is essential for my needs. I'm trying to measure the risks and benefits here: It seems to me that there are some risks that I am taking if I DO win the case and get the refund.
