I have a serious dilemma with eBay as they have broken their contract and I do not know what my rights are in pursuing legal action against them. My friend sold an item on eBay in October last year when my PayPal was linked to her eBay account, in December the buyer said the item was not sold as described, a lie but something we knew it's impossible to fight eBay for. So eBay give the buyer 10 days to return the item and they will issue a refund which we come to terms with and accept. However 10 days passes and we still don't receive the item, it's tracking shows as in progress, but at this point eBay have already refunded the buyer depsite us not receiving the goods, and the case/contract clearly stated on receipt of the goods they would receive the refund. So we open an a case to appeal and this is granted, at this point we expect the refund of the value of the item returned and nothing more to come of it. The buyer if he legitimately sent the item back can claim on the postage insurance so there should be no worries for him there any way. However what ensues is the following, my friend does not receive her money back which was taken, despite the appeal being granted. Instead a week or so later the same value of money is debited from my account, so now they have double charged us for something which should never have taken place. After hours and days of constant calling they say they will refund us, however neither of us have received our money back to our bank accounts. On a new phone call we're told it wasn't done and they will manually refund. And now yesterday they have charged the transaction fees for the refund, which again should never have gone through, but they've charged us both as well which is even more ridiculous. In short eBay have illegally taken £1100 from the pair of us and we are going under financially as a result. If anyone else has experienced something similar it would be helpful to get some advice on what can be done to resolve the issue and if it's possible to claim back any additional charges that have been incurred due to the theft of our money. It's a monumental mess up by the eBay billing agreement team and we're getting nowhere disputing it through the normal channels.
