@damong333 I have had numerous dealings with Modomobi and have enabled numerous consumers to recover fraudulent payments. Modomobi specialise in auto-subscription fraud. They use exploits embedded in web pages to "subscribe" consumers to their "services" without their knowledge or consent. Until recently, they used these exploits to subscribe consumers to services paid for through their phone-bills. We've successfully put a stop to this by requiring two factor authorisation in such cases. Modomobi now seem to be using similar tricks to autosubscribe via Paypal. Some technical background to the exploits used are here: https://www.surecloud.com/resources/blog/bbc-watchdog-research-paper-payforit In order to make lawful charges to your Paypal account, Modomobi need to be able to prove the existence of a contract. Legally, if you believe you did not consent to the charges, you are entitled to ask Modomobi for proof of consent. Without such proof the charges are unlawful. They will tell you that they have complied with all Paypal's rules - but that is not proof of consent. You are entitled to be given details such as the exact date and time you allegedly consented, screenshots of the "journey" through the web pages which you allegedly saw during the signup, and technical details of the device and connection from which you signed up. We have found that the best way to force Modomobi to either provide this evidence or to provide a refund of the charges is to send them a Letter Before Action. This should tell them that you will start a claim in the County Court if the requested details are not provided or a full refund is not received by a future date which gives them at two weeks to consider their response. Usually this gets a refund - unless of course you did subscribe, in which case they will provide the details which may jog your memory. If they fail to respond, you will need to decide whether it is worth instituting a claim through Moneyclaim Online. It is unfortunate that Paypal continue to allow scammers like Modomobi to use their services.
