Seller and buyer cancel sale

I won an auction. I then heard from the seller that he no longer had the item I won. That was okay with me. I don't want to send the buyer money, just to have him refund me. What other options do I have?

A refund is pretty much the only option - you can't force the seller to send you the item.

 

You could file for an "Item not received" and he'd get a slap from ebay, but that's about it.

 

I'd make sure that he refunds really quickly, though - like in hours, not days.  If he doesn't, then file the Item not received dispute here;

and escalate it to a claim as soon as possible.
