I made a payment, the seller got is as pending but because it was something straight away I asked to refund, she told me she has pressed the refund option straight away (few minutes after my payment) the refund is showing on her PayPal page as (refund pending 1-2 days) few days she told me status has changed to (refund pending 21 days) this is real ?

If its marked as completed in your Paypal account then you have paid. The fact its pending on the sellers account is between them and Paypal.
Funds for new sellers are held for 21 days but released more quickly if they provide a tracking number (delivery + 1 day).

Even if the funds were withdrawn to their bank account they are still obliged to issue a refund if they lose a dispute. The hold is to protect Paypal from bad sellers that refuse, meaning Paypal may have to refund the buyer instead putting the sellers account into negative until they pay Paypal back.

If they refuse to send item/service then you could file a dispute for non receipt.
That may impact their paypal account in some way if they continue doing so.

HOWEVER if you prefer a refund then a seller can only issue a refund via cleared funds in their balance OR funded via their bank account. If they don't want to issue funds from their bank account (and get paid back when the new seller hold payment is released) then you may have to wait for 21 days.

 

You should not have to its up to the seller, the new seller hold holds funds for 21 days BUT released earlier if the seller provides trackable proof of delivery of the item to the buyer.
