This is a very long story.
So im a student in universtiy, my phone now is becoming quite slow so I decided i needed a new one so i went onto facebook marketplace. I found a seller selling the phone i wanted for £350 but i managed to haggle and get it down to £300. I asked the seller if he would take the money through goods and services as this is a tell tale sign that they are a scammer (if they are a scammer theyll normally say friends and family only). So i paid the £300 and asked him to send me the serial number for the phone. The phone that i bought from him was purple but he sent me a serial number for a black phone, i gave him the benefit of the doubt and thought maybe hes selling to someone else at the same time.
He arrives at the post office and then requests that i quickly send him money for shipping, I sent him the money and then he sent me a picture of the parcel in the post office (this is important), but then after he sends the picture i discover that the address is slightly wrong, i ask him to change it and he tells me that the worker at the post office is asking him to pay the shipping fees again, so he requests that i send him the money again, but this time he says that he will pay half of it since it was his mistake, so then i send him money for half of the shipping costs. He also says he will throw in a charger as sorry for the mistake.
The next day the parcel arrives at my student accomodation and upon opening the package I kid you not i discover that he sent me a horrible histories book. So i instantly go to paypal and open a dispute, at this point im just extremely glad that i paid through goods and services. I open the case on december 5th. Me and paypal go back and forth, they ask for evidence and i give it to them, this cycle went on for a month.
The evidence I gave them was proof that I was buying a certain phone, and proof that i recieved a book instead. One way i tried to prove that i recieved a book was by comparing weight. Remember when he sent me a picture of the parcel, on the front, since the post office had already labled it, it had the weight, and this weight was 0.291kg. I went on the internet to find the weight of the book that he sent me, and the weight there is 0.30000kg. So I assumed that it was rounded up. The weight of the phone that he sent me (no box) is 0.240kg so with the box it would weigh a lot more, on top of that he said that he included a brand new charger in the box which would make the total weight of the package much larger than 0.291kg.
I called the seller out by texting him "Why would you send me a book" and he didnt reply to it, and to this day he hasnt replied. I also documented this and sent it to paypal as it was extra proof.
But today i recieved an email from paypal telling me the case was decided in the sellers favour, due to me not providing enough proof.
WHAT?!!
What do i do now. I cant afford to be giving out £300 for no reason. Thanks

I sympathize with you. It seems that PayPal automatically believes the vendor instead of the buyers (us). I've been going through the same crap. PayPal is believing the lying vendor. Therefore, I'm cutting ties with PayPal. I'm sure there's competition.

Exactly. It made me think to myself what is the point of buyer protection if it doesnt protect you. Now the scammer has ran off with my money after i did what i could to protect it. On top of that it took a month to recieve an unfavourable outcome.
Im going to call them tomorrow to see if i can resolve it over the phone, if not then ill call my bank for a chargeback.

Bindu, You say you "review all cases objectively", but I find that is a big LIE. In my case PayPal took the side of the vendor (Alibris) even after I had stated my side and shown proof of their lie. (I have nothing to show for the $26.36 I paid Alibris through PayPal.)
Because PayPal is so biased and prefers to support the lying thief, Alibris for $26.36 (for which I have received nothing), I am cancelling my PayPal account.
P.S. PayPal doesn't let me into my dispute area to be able to post any comments.
