Seller sent me counterfeit item, can’t ship it back for a refund

Hi, 

so I recently bought a diagnostic scanner and paid via paypal. It has arrived and turns out it’s a counterfeit item. It isn’t working like a real one should and I contacted the manufacturer who confirmed it’s fake and will share a report according to what paypal asks for. The fake in question has the logos of the original manufacturer too, and sold at a similar price which made be believe it was real.

 

But I skimmed through paypal policy, and they say I am supposed to send a shipping number and return it. But here’s the worst part, I cannot send this out due to it being a counterfeit item, my post office refused to take it and told me I can be held liable for it, and trying to hide it will not be okay and a huge risk for me.

 

Now I’m stuck, I can’t send it back as described, and due to that I cannot get a refund. The seller is insisting to claim it under a different category, which seems dicey. I don’t want to get into a legal issue and just want my money back. What can I do?

Before you file a claim for a fake item its best to get in writing from the firm that makes the item or a retailer that sells it that it is fake.

Then submit it to paypal and they 'may' decide to find in your favour without the need to return.
