Ebay seller using different return address

Hello, 

 

Approximately four months ago I bought a mobile phone, which arrived as described and I was very happy with it. This week it has been blacklisted by all network carriers (UK), and a checkmend report (a service Ebay us to verify info on stolen / blacklisted mobiles) says that it has been registered as lost or stolen by a mobile network. Ebay have told me it is over 30 days so no longer covered by the money back guarantee, and since it has not been filed as stolen by the police (apparently checkmend can show this, and my report only mentions network carriers) they will not treat this as sale of stolen goods. They have essentially told me I need to request the seller for a refund, but that will be at their discretion. I contacted the seller who has offered to refund me if I return the item, however, they have requested that I send the item to a different address to the one registered to their eBay account. Since the time period is within 6 months I can open a dispute with Paypal. Should I send the item to this alternate address, since eBay is no longer willing to get involved? Or would doing this violate Paypal's terms?

 

As far as I can see the Payal transaction only shows ebay as the vendor with no address. But I'm worried that if I send the item back, the seller could say they haven't received it or come up with some other issue. If I open a Paypal dispute can the seller then, via the dispute process, provide whatever return address they want so that I am covered?

If you want to open a dispute with paypal then select item received but not as described.

Put in as much information as you can and if you don't get an offer of a refund etc then escalate the dispute to a claim within 20 days.

That is when paypal get involved, IF and only if they find in your favour they will tell you to return the item trackable back to the seller and then supply them the tracking number. Paypal will give you the return address they want you to send the item back to.
