How do I open a dispute with a seller when a purchase goes wrong?

You can open a dispute in the Resolution Centre of your PayPal account within 180 days of payment if:
•You don’t receive the item OR service
•You receive an item but it’s significantly different than the description on eBay or on the seller’s website (or you receive a totally different product).

By opening a dispute, you can communicate directly with your seller to work out a problem transaction.

If you reach an agreement with the seller you can close the dispute. If you're still not happy with the result, you can escalate the dispute into a claim. Paypal will review the claim and decide on reimbursement.

These steps apply to Personal accounts. If you have a Business account, please log in to see the steps that apply to you.

To open a dispute:
1.Log in to your PayPal account.
2. Click on the transaction and use the resolve a problem option at the bottom of that details page.

Note:
•Generally buyers must wait at least 7 days from the date of payment to escalate a dispute for an item not received
•Where an item has not been received, please ensure you have given the seller enough time before opening a dispute

Do not close the dispute until you have a refund or your item.
If a seller states that they can't refund until you have closed the dispute don't believe them.
Escalate the dispute to a claim within 20 days (before it times out), if you need Paypal to get involved.

If you lose because the seller provides a fake tracking number then post back here for more advice.
If the item arrives and its not what you ordered / not as described then make sure you change the dispute quickly from non receipt. If the dispute times out before you can change it then contact customer services to open a second dispute for the new reason.

Activate the below link in case you have to return the item at Paypals request (or the correct one for your country as this is the U.S link).

If that does not work then if you funded your paypal payment via a card then contact your card issuer and see if they will issue a chargeback.

I also have a dispute with Briquao Co., Ltd following the receipt of damaged earrings due to inadequate packaging. 

Website is Fallingdew and have found 3 emails (which I'm unable to provide here?) and they all have a similar message.

At first the emails were written in language that appearing to be progressing, asking for photos of the earrings (with bent posts) however they appear to have no intention of providing a refund.

  Firstly they wrote: 

Thank you for contacting us!
We have received the email.
We are really sorry that we're off work now.
Our working time is from 10am to 7pm (GMT 9), Mon to Fri.
Please do not worry.
We will arrange a dedicated customer service to solve your problem within 12 hours.
We will try our best to help you.
Have a nice day!

which sounded very positive, then they emailed:

Thanks for your email.
We’re so sorry for the inconvenience.
Can you please send us some pictures (jpg. less than 1MB) of the item you received?
So we can check the problems and help you.
Thanks.
 
I provided the requested photos and received this email:
Thanks for your kind cooperation.
As our warehouse checked, your product has no quality issue.
With some simple prodecures, it can work as normal
Sorry for the inconvenience it has brought to you.
Your kind understanding would be highly appreciated.
 
When I emailed saying the earring posts were both bent and this would have weakened the posts, they suggested the following:
 
I’m sorry for the bad shopping experience.
If you really don’t like them, I think you can give it to your friends as a gift. Maybe they will like it very much.
Thanks for your understanding.
 
I have logged a dispute with PayPal.
I do hope PayPal investigate and remove this online seller from their services - online sellers like this will continue to rip people off if there are no repercussions.

Further to the issue with Briquao Co.,Ltd (Fallingdew):

This is my first experience with an online seller who is not providing a refund for damaged goods.

After numerous emails, this oneline seller is now offering to refund 3USD for damaged earrings for which I paid 34.33USD.

I have lodged a dispute with PayPal.

 

Their correspondence:

Thanks for your reply. As our warehouse checked, the product we sent to you is correct indeed.
In this case, we can only refund your money until you return the product to our specific warehouse.
Please be kindly noticed that you have to pay the shipping fee for the return.
 
Our warehouse receiving returned goods is not the one on the waybill. If you still want to return
your order, please do ask me for the exact address. DO NOT RETURN IT TO THE ADDRESS ON THE
WAYBILL, otherwise refund will not be supported.
 
Our warehouse is in China now, thus the shipping fee may be very expensive to you. So how about we refund you 3USD 
as compensation and you give the product to others? Your kind understanding would be highly appreciated. Thank you so much.

Continuing my email correspondence with Briquao Co.,Ltd (Fallingdew)

The latest email offered me the following (I paid 34.33USD for earrings damaged in transit due to inadequate packaging).

 

We’re sorry for the inconvenience.
The only thing I can do is to compensate you as much as I can.
Can I offer you a compensation of 5USD?
I hope you can accept it.
Wish you all the best.
 

I have responded that I would be out of pocket nearly 30USD, and they would have the earrings that they consider can still be worn (and said I can give to a friend if I don't like them).

I have also reminded them that if PayPal were to withdraw their services they would lose thousands of sales.

I will continue to follow up on the dispute I have raised with PayPal.

Briquao Co Ltd trading as Fallingdew have finally provided a return address after I raised a dispute. It is my understanding that PayPal monitor the level of disputes raised for an online seller, so PLEASE raise a dispute or otherwise sellers like this will get away with taking money for damaged/poor quality goods. (In the meantine they offered me 3USD, then 5USD, then 7USD always saying that the cost of returning the goods would be high, so probably not worth it.  I advised of PayPals returns policy.)  I will NEVER deal with this organisation again.

Now the wait to see if I actually do get a refund from Briquao Co Ltd.

That’s great to hear that they’re giving a return option. I got $8 back after the suggestions of giving the items to friends etc, but gave up on everything else so will put the items into a charity shop. Makes sense to raise a dispute but I will be more careful in future Hope you get your refund

Good news! I have FINALLY received a refund from Briquao Co.,Ltd.  This was only after PayPal contacted them once I raised a Dispute.

As you can see from a sample of the emails I received from them prior to PayPal becoming involved, they were engaging delay tactic, offering me 3USD, then 5USD, then 7USD and saying I should give the damaged earring to a friend, and the cost of posting earrings back to China would be prohibitive. 

My advice is to avoid this business and NEVER PURCHASE FROM Briquao Co., Ltd.

If you are seeking a refund from Briquao, call PayPal and raise a Dispute - this service was fantastic, constant communication and a great result. 

I feel sorry for purchasers who used a credit card, they will have little hope of getting a refund.

i had the same experienced. received crappy clothes and there is no more link to the website. they agreed to repay me if i return, i paid $47 for the return and they refunded the money, it was good that it was through PayPal bc i don't think they would have communicated otherwise. PayPal also compensates $30 for shipping so I only lost $17 which is fine and lesson learnt. If you have not done so file a dispute.

I am waiting for an item that I ordered a while ago. I got a trackingnumber and it shows the journey of that package and lastly it looks as like it has gone trough customs and are in the hands of the transport vessel to get it out to me. The strange thing is that I have no idea which transportation company are handling this?

I had a bad dealing with them. I ordered some shirts and then realized they were in Chin a I tried to cancel the order with 1 day, the order day being New Years day and the next day being Sunday. Thjey told me it had already gone out so I could not cancel! They would not even give me a tracking number even after I requested one. After repeatedly telling them I was going to open a dispute with Paypal they finally refunded me. I thought for sure I had been scammed. Their website had clothing and the same pictures as Carbon2Cobalt's pictures in it's catalog but at a very reduced price. That made me realize something wasn't right.
