Can't file a dispute because the seller hasn't claimed payment

I recently bought an item through an online store that accepted paypal, and I haven't received any tracking numbers/emails/anything regarding the item. I emailed the seller directly and asked about them, and no response. I'm pretty sure it's an inactive store from a couple of months ago, as it was only selling a promotional item. However, since the payment is unclaimed I can't file a dispute over it, and I'm not going to lie and say it was unauthorized to get my money back. What do I do? The e-check cleared 3 days ago, and I've emailed him more than once.

can you ask for a charge back from your bank or credit card company (there my be a service charge for this)?
