Protection against buying a possible contract phone?

Am I covered if I buy a phone from someone on ebay and it turns out to be a contract phone that they got as a 'free upgrade' and the seller stops paying the contract and the phone I've bought becomes blacklisted? It's not the innocent buyers fault. I've heard many things like the contract only needs to be paid for 6 months and then legally the phone is not owned by the network anymore but I don't know why to trust or believe. With so many phones on the market you don't know what's genuine and what's a contract phone. Apologies if this is in the wrong section.
