payment pending following a hacked seller account

hi, wonder if anyone can help. I bought an item on ebay and later was sent an email from ebay saying the seller had been hacked and my purchase had been cancelled. i contacted the seller who i assume was annoyed he'd been hacked and he said i'd get my money back. Paypal have left it in pending payments and have said he hasn't accepted it yet. He obviously won't accept it so how do i get it back?

If it says pending / unclaimed in your Paypal account AND there is a cancel option then you can cancel the payment.

If it says pending / unclaimed in your Paypal account AND there is NO cancel option then the payment will 'time out' at 30 days post-payment.
