If seller purpose dont response can i stilll back my money? I still need wait 10 working days or sometime will know the result less than 10 days?

Seller has 10 days to respond and then paypal will review / refund within 48 hours of the sellers deadline expiring.

 So I still need wait 10 days, i already inform seller go to response and he promise will refund to me but i feel he purposely dont want give any response, so i can get back the money? Paypal will ask seller to refund to me? If seller account dont have any money already, i still can get the refund?
