My refund case got closed by paypal although I deserve the refund.

Here is the description I added in my case:

So I used to play on this gaming server and payed for digital goods. The items were delivered but a year after my access to these items were removed. I was declined to access these purchased goods for no given reason and the seller refused to refund my purchases. The owner of this server was well known for adding hidden fees in his purchases and I have been getting charged by those monthly fee that was never included in the original purchase. The owner acknowledged on his website: https://luckyprison.com/ first post that he used a scam business model and he will be offering some refunds. I do not wish to talk to the owner or staff was not allowing me to access my purchased items and wish to demand a full refund on all my purchases made on the server.

 

I actually got scammed left and right by this dude and paypal just closed my case.

 

On the link, in the first post the seller ACKNOWLEDGES that he scammed people and he will be offering refunds 

"In our quest for expansion, we made some fatal errors. The business model we ended up picking was short-sighted and left a lot of people feeling burned. Although we operated with disclosures on the checkout page, in the terms of service, emailed users before ever billing them, and allowed for self-service cancellation, we still ended up with a lot of people that felt they were duped. This is regrettable, and I sincerely apologize for this.

In order to make things right, I have set aside money for a refund fund. We're offering full refunds to anyone who has not already obtained a refund, or disputed the charge."

 

And no said email was sent to cancel this unwanted subscription

 

And paypal immediately marks my case as this :

Not as described - Claim - #PP-006-802-718-448

We're unable to decide this claim in your favor at this time. PayPal's Buyer Complaint Policy applies to the shipment of goods but not to disputes about merchandise quality.

 

How is what anything I said related to merchandise quality. I got scammed and the seller acknowledges it and IS offering a refund but will not let me get in contact with him.

 

1. The case got closed like 20 seconds after opening it so it would be nice if you ACTUALLY READ the cases and not just close them. 

 

2. I will demand a full refund on all my purchases made on the server which is a lot of money that the dude ows for scamming me so before I open a report on each purchase and you guys immediately close it without reading, I would like you to know that I will DEMAND my money back.

My access was actually removed from these items way before a year on most of my purchases. like less than a month.

The seller has admitted that their fees were disclosed in the terms of service etc. which has covered them from a dispute. PayPal would expect the customer to read all legal documents on the merchant's website prior to purchase / enrolment to the service.

 

As the merchant provided an online cancellation procedure and pre-billed emailing, this applies an additional layer of protection for them, as the customer had an advance notice, which meant there was an opportunity for them to cancel it beforehand.

 

I can understand your frustration, however from PayPal's viewpoint, the buyer is responsible for any losses, as a direct result of failing to aknowledge the merchant's terms of service and other related legal documentation.

 

Despite their team's admission, there is no basis for PayPal to automatically refund their customers for them. It is at the sole discretion of the merchant to manually issue any voluntary refund(s) to their customers.

 

Your request was automatically closed by the system, as it did not meet the criteria for a case. PayPal will only enforce reimbursement on a seller when the criteria for such is met, in accordance with their protection policy.

 

You should contact the seller to request a refund. Unless the seller provided an exact amount of time that the item(s) would last for, withdrawn access could have been performed through a clause in their terms of service, hence they are protected from a claim for such.

 

If the seller has broken the law to obtain sales, such as fraud by misrepresentation, they can be reported to Action Fraud UK. This will not warrant an immediate refund or police report, however it could help to establish a clear picture of their illicit activities.

 

This is a complex scenerio and without a PayPal specialist, I cannot make further comment about the case outcome. However, the advice I have provided is based on the material avaliable to me at present.

1. You have no buyer protection for virtual items for 'not as described'.

2. You can't open a paypal dispute post 180 days.
